October 29, 2002 - Unfinished Business - (c) CA-02-05 CITYWIDE - The City of Portsmouth requests an ordinance to amend Chapter 40 of the Code of the City of Portsmouth, Virginia by amending Section 40-44.1 and Table 40-44-4 pertaining to dimensional requirements for nonresidential districts; Section 40-43.4, Tables 40-43.1-1, 40-43.1-2, and 40-43.1-3 pertaining to conditions for accessory dwelling uses and structures; and Section 40-71.2 and Section 40-73 pertaining to parking lot screening and landscaping requirements. Deferred from October 8, 2002 City Council meeting. 1. William J. Crodick III, 3314 Broadway Street, spoke in opposition to this item. Motion by Ms. Randall, and seconded by Mr. Benn, to concur with the recommendation of the Planning Commission that CA-02-05 be approved, and was adopted by unanimous vote. Consent Aqenda 02 - 302 - Group housing use permit and use permit: Motion by Mr. Pitts, and seconded by Mr. Benn, to adopt the following resolutions, approved at the October 8, 2002 meeting, and was adopted by the following vote: 02-302(a): "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT (GHP-02-04) TO VAN JOHN HILDRETH TO CONSTRUCT THREE LOFT APARTMENT UNITS AT 915B HIGH STREET. WHEREAS, Van John Hildreth has made application pursuant to Section 40-112 of the Code of the City of Portsmouth, Virginia (1988), as amended, for the approval and granting of a group housing use permit for three loft apartments to be constructed at 915 High Street, Portsmouth, Virginia, more particularly described as follows: GHP-02-04 Beginning at the southwest corner of High Street and Chestnut Street; thence, in a southerly direction 228' to a point; thence, in a westerly direction 113'+ to a point; thence, in an northerly direction 114' to a point; thence, in a westerly direction 60' to a point; thence, in an northerly direction 114' to a point; thence, in an easterly direction 173' to a point of the beginning. and WHEREAS, the Planning Commission has reviewed such application and site plan submitted therewith and has recommended conditional approval of said application; and WHEREAS, the applicant has been informed that approval of the group housing project pursuant to Section 40-116 only grants an exemption from certain requirements for residences as stated in said section and does not constitute a waiver of any other requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any other applicable local, state or federal law or regulation; and WHEREAS, the applicant is aware that building permits and any other required permit will be issued only upon compliance with the ordinances, laws or regulations applicable thereto.
