October 29, 2002 <br /> <br />- Unfinished Business - <br /> <br />(c) CA-02-05 <br /> <br />CITYWIDE - The City of Portsmouth requests an ordinance to <br />amend Chapter 40 of the Code of the City of Portsmouth, Virginia <br />by amending Section 40-44.1 and Table 40-44-4 pertaining to <br />dimensional requirements for nonresidential districts; Section <br />40-43.4, Tables 40-43.1-1, 40-43.1-2, and 40-43.1-3 pertaining to <br />conditions for accessory dwelling uses and structures; and Section <br />40-71.2 and Section 40-73 pertaining to parking lot screening and <br />landscaping requirements. Deferred from October 8, 2002 City <br />Council meeting. <br /> <br />1. William J. Crodick III, 3314 Broadway Street, spoke in opposition to this item. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Benn, to concur with the <br />recommendation of the Planning Commission that CA-02-05 be approved, and was <br />adopted by unanimous vote. <br /> <br />Consent Aqenda <br /> <br />02 - 302 - Group housing use permit and use permit: <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Benn, to adopt the following <br />resolutions, approved at the October 8, 2002 meeting, and was adopted by the following <br />vote: <br /> <br />02-302(a): <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT <br />(GHP-02-04) TO VAN JOHN HILDRETH TO CONSTRUCT THREE LOFT <br />APARTMENT UNITS AT 915B HIGH STREET. <br /> <br /> WHEREAS, Van John Hildreth has made application pursuant to Section 40-112 <br />of the Code of the City of Portsmouth, Virginia (1988), as amended, for the approval <br />and granting of a group housing use permit for three loft apartments to be constructed <br />at 915 High Street, Portsmouth, Virginia, more particularly described as follows: <br /> <br />GHP-02-04 <br /> <br />Beginning at the southwest corner of High Street and <br />Chestnut Street; thence, in a southerly direction 228' to a <br />point; thence, in a westerly direction 113'+ to a point; thence, <br />in an northerly direction 114' to a point; thence, in a westerly <br />direction 60' to a point; thence, in an northerly direction 114' <br />to a point; thence, in an easterly direction 173' to a point of <br />the beginning. <br /> <br />and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site <br />plan submitted therewith and has recommended conditional approval of said <br />application; and <br /> <br /> WHEREAS, the applicant has been informed that approval of the group housing <br />project pursuant to Section 40-116 only grants an exemption from certain requirements <br />for residences as stated in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the <br />City of Portsmouth, Virginia, or any other applicable local, state or federal law or <br />regulation; and <br /> <br /> WHEREAS, the applicant is aware that building permits and any other required <br />permit will be issued only upon compliance with the ordinances, laws or regulations <br />applicable thereto. <br /> <br /> <br />
