October 29, 2002 <br /> <br /> At a Regular Meeting of the City Council on Tuesday, October 29, 2002, <br />there were present: <br /> <br />Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E. <br />Moody, Jr., Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. Timothy <br />Oksman. <br /> <br /> Councilman Cameron C. Pitts opened the meeting with prayer, which was <br />followed by the Pledge of Allegiance to the Flag. <br /> <br />Vice Mayor Griffin called the meeting to order and welcomed all in attendance. <br /> <br /> Motion by Mr. Pitts, and seconded by Ms. Randall, to approve the minutes of a <br />Called Meeting on October 8, 2002, and a Regular Meeting on October 8, 2002, and <br />was adopted by unanimous vote. <br /> <br />02 - 318 - Presentations: <br /> <br />Presentation by Harry Gregori, Assistant to the Director of Pollution Prevention, of a <br />certificate for Environmental Enterprise designation by the Department of <br />Environmental Quality. (Dennis Bagley, Joe Strait, Captain Mark Joyner) <br /> <br />Proclamation presented to Albert J. Taylor, Jr., President, The Portsmouth <br />Community Foundation Board of Directors for "Portsmouth Community Foundation <br />Week." <br /> <br />· Special presentation by Douglas Smith on the behalf of the Hampton Roads Area <br /> Commercial Real Estate. <br /> <br />- Public Hearing - <br /> <br />02 - 319 - Public hearing to consider the adoption of an ordinance imposing a surcharge <br />on water rates due to the emergency resulting from severe and continuing drought <br />conditions. <br /> <br />Mr. McCoy read a statement recommending that the interim drought water surcharge <br />not be expended beyond its current cut-off date of November 8, 2002. <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Pitts, to withdraw public hearing item <br />02-319 and to remove item 02-322 from consideration on the City Manager's Report, <br />and was adopted by the following vote: <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall <br />Nays: None <br /> <br />02 - 320 - Public hearing on a use permit application: <br /> <br />(a) UP-02-19 <br /> <br />DOWNTOWN NEIGHBORHOOD - Roslyn Askew requests a use <br />permit to operate a restaurant/entertainment establishment at 430 <br />High Street. The Comprehensive Plan recommends commercial <br />development. <br /> <br />1. Michelle Weiss, 108 London Street, spoke in opposition to this item. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Moody, to concur with the <br />recommendation of the Planning Commission that UP-02-19 be denied on first and final <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall <br />Nays: None <br /> <br /> <br />
