R, C. P.

August 15, 191~.

(Signed). J. Edw..Jo~uson,

On motion, the report of the Co~m~ittee was adopted, an appropriation
wagon being referred to the Finance Committee.

Chairman C. C.
for the auto-patrol

Claims--

Hon. Common Council.
Gentlemen:-~ Your Committee on Claims respectfully reports

herein concerning the following matter referred t0 the Joint Committee on Claims July lS, 191E:

Referred by Board of Aldermen.July 18th.

A claim of Frank Dunkum to amount of $79.E5, for a horse killed and harness burned at the
Incinerator.
Your Committee, having investigated the claim of Frank Dunkum against the City for the
killing of one horse and destruction of certain harness, beg~ leave to report that, in the opin-
ion of a majority of the Committee, the claim, amounting to $79.~5, should be allowed; and we,
therefore, recommend the payment of same.
In making~this recommendation, we believe the accident was due to the absence of neces-
sary block, which, in our opinion, was no fault of the claimant.

(Signed).
The following minority report was read also:

Thcs. P. Cooke~
Acting Chairman C. C.

Hon. Common Council.
Gentlemen:-- I desire

to offer the following reasons for objecting to the majority report of the 01aims Committee:
"The load behind the horse which was killed, had been dumped and the trap~stuck in its
place, the horse had walked to the end of the level of the exit. If blocks had been used to
dump the load~ the ~perat2r,. u~der the conditions~ would have had a right to move them in o~der
to drag the trash~ ~c., which ~s dumped along the outside of the pit, into the pit. The drmver,
seeing the horse restless, caught him by the bridle~ which caused him to back and before the
horse could be stopped~ he backed into the pit. The day on which the horse was killed was the
first day he had been used at the plant and the operator, previous to the adcident, '~ad suggest-
ed to the driver to have the contractor change horses'~ which was not done.
"I, therefore, place the reason for this accident upon the ummanageable condition of the
horse and the action of the driver,~for which the claimant is responsible, and~ therefore, as
the minority member of your Claims Committee, recommend that the maJority~report be amended to
read that the claim be not allowed.

(Signed). Ellis N. Moore,

The majority an~ minority reports were discussed by Messrs. Cooke and Moore, and finally,
the minority report was adopted, and bM the. following vote~
Ayes-- Corbitt, Hall, Parrish,
Hanvey, Dewson, Moore, Johnson, Heath, Brinson, Cross, Tyler, Hawks, Hutchins, 13.

UNFINISHED BUSINESS.

First.
