<br /> Gentlemen:-~ Your Committee on Claims respectfully reports
<br />
<br />herein concerning the following matter referred t0 the Joint Committee on Claims July lS, 191E:
<br />
<br /> Referred by Board of Aldermen.July 18th.
<br />
<br /> A claim of Frank Dunkum to amount of $79.E5, for a horse killed and harness burned at the
<br />Incinerator.
<br /> Your Committee, having investigated the claim of Frank Dunkum against the City for the
<br />killing of one horse and destruction of certain harness, beg~ leave to report that, in the opin-
<br />ion of a majority of the Committee, the claim, amounting to $79.~5, should be allowed; and we,
<br />therefore, recommend the payment of same.
<br /> In making~this recommendation, we believe the accident was due to the absence of neces-
<br />sary block, which, in our opinion, was no fault of the claimant.

<br /> Gentlemen:-- I desire
<br />
<br />to offer the following reasons for objecting to the majority report of the 01aims Committee:
<br /> "The load behind the horse which was killed, had been dumped and the trap~stuck in its
<br />place, the horse had walked to the end of the level of the exit. If blocks had been used to
<br />dump the load~ the ~perat2r,. u~der the conditions~ would have had a right to move them in o~der
<br />to drag the trash~ ~c., which ~s dumped along the outside of the pit, into the pit. The drmver,
<br />seeing the horse restless, caught him by the bridle~ which caused him to back and before the
<br />horse could be stopped~ he backed into the pit. The day on which the horse was killed was the
<br />first day he had been used at the plant and the operator, previous to the adcident, '~ad suggest-
<br />ed to the driver to have the contractor change horses'~ which was not done.
<br /> "I, therefore, place the reason for this accident upon the ummanageable condition of the
<br />horse and the action of the driver,~for which the claimant is responsible, and~ therefore, as
<br />the minority member of your Claims Committee, recommend that the maJority~report be amended to
<br />read that the claim be not allowed.

<br /> First. Matters adopted by the Common Council July 9th and referred to the Board of Alder-
<br />men for concurrence.

<br /> To withhold pay for rent of the Ferry building, pending settlement of matter in dispute a-
<br />bout conditions of rent.
<br />
<br /> To allow the paid men of the Chambers' fire company to go with the Company on a trip north,
<br />with consent of Chief of the Fire Department.
<br />
<br /> To instruct the City Attozney tO bring a friendly suit against the Virginia Railway & Power
<br />Company for $?,050.5~, as its proportion of cost for grading and lowering tracks in the Sixth
<br />
<br /> To instruct the Street Committee and City Attorney to proceed by condemnation or otherwise,
<br />to acquire the right of way for D~ke street, between Nashington and Green.
<br />
<br /> To instruct the City Attorney to advertise for bids for the purchase of a franchise to 'lay
<br />another track on High street, from Chestnut to Twelfth avenue.
<br />
<br /> To grant the Superintendent of the Fire Alarm System a five day leave of absence, subject
<br />to approval of Chief of the Fire Department.
<br />
<br /> To grant the Clerk a thirty day leave'of absence, following meeting of the :Board of Alder-
<br />men.
<br />
<br /> To authorize the Presidents of the two branches of Council to appoint one man, the Sixth
<br />and Seventh Wards to appoint one man, and these two appointees~to appoint a third man, for
<br />posing ~ Board of Arbitrators, to settle the disputed question as to who should pay for water
<br />hydrants in the Sixth and Seventh Wards, and to allow the decision of these arbitrators to be
<br />final.
<br />
<br /> To authorizethe ~emetsry Committee to advertise for bids to repair wall around the Cedar
<br />Grove cemetery.
<br />
<br /> To instruct the Street Committee to proceed with the paving of First street within 30 days
<br />after contract for same is ~igned.
