<br /> Motion by Mr. Clemons, and second by Mr. Griffin, to adopt
<br />the following ordinance and was adopted by the following vote:

<br /> ,,AN ORDINANCE TO AMEND SECTION 35-2(b) OF CHAPTER 35 OF
<br />THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988), PERTAINING
<br />TO TAXATION".

<br />94-344 Letter-from the City Manager recommending adoptiOn of
<br />a resolution to.~unend-the~Articles of Incorporation of the
<br />Sports Authority of Hampton Roads, Virginia.
<br />
<br /> "As currently written, the Article of Incorporation Of the
<br />Sports Authority of Hampton Roads, Virginia state that the
<br />purpose of the Authority is to acquire, construct, equip,
<br />finance, maintain and/or operate" a public recreation and
<br />sports facility." Consequently, legal counsel to the Authority
<br />has advised that it is currently limited to undertaking a
<br />sinqle project.
<br />
<br /> In order to correct this situation, the Authority at its
<br /> June 23, 1994 meeting directed legal counsel to draft a
<br /> resolution for adoption by the Authority's member governing
<br /> bodies which would allow it to undertake multiple projects. The
<br /> resolution is attached for your consideration and action.
<br />
<br /> I, therefore, recommend your approval of the attached
<br /> resolution as proposed by the Authority."

<br /> Motion by Mr. Robinett, and seconded by Mr. Martin, to
<br /> adopt the following resolution, and was adopted by the
<br /> following vote:
<br />
<br /> "A RESOLUTION OF THE COUNCIL OF THE CITY OF PORTSMOUTH,
<br /> VIRGINIA, AMENDING THE ARTICLES OF INCORPORATION OF THE SPORTS
<br /> AUTHORITY OF HAMPTON ROADS, VIRGINIA.
<br />
<br /> · WHEREAS, by concurring resolutions adopted by the
<br /> Councils of the Cities of Hampton, Newport News, Portsmouth,
<br /> Norfolk, Virginia Beach, Chesapeake and Suffolk, Virginia, and
<br /> the Board of Supervisors of Isle of Wight County, Virginia
<br /> (collectively the Participating Political subdivisions"), The
<br /> Sports Authority of Hampton Roads, Virginia, (the "Authority")
<br /> was created pursuant to the Public Recreational Facilities
<br /> Authorities Act, Chapter 29, Title 15.1-1271, et seq. (the
<br /> "Act"); and
<br />
<br /> WHEREAS, the Participating Political Subdivisions desire,
<br /> by adoption of concurring resolutions, to amend the Articles of
<br /> Incorporation of the Authority to reflect the current principal
<br /> office of the Authority and to modify the purposes of the
<br /> Authority to include undertaking multiple projects as
<br /> hereinafter set forth;
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
<br /> OF PORTSMOUTH, VIRGINIA:
<br />
<br /> 1. Paragraph i of the Articles of Incorporation of the
<br /> Authority is hereby amended to read as follows:
<br />
<br /> "1. The name of the authority is THE SPORTS AUTHORITY OF
<br /> HAMPTON ROADS, VIRGINIA, and the address of its principal
<br /> office is The Regional Building, 723 Woodlake Drive,
<br /> Chesapeake, Virginia 23320, or such other place as the
<br /> Commissioners of the Authority shall establish, from time to
<br /> timed by written notice to each member of the Commission and to
<br /> the Clerk of the governing body of each Participating Political
<br /> Subdivision."
