<br /> This proposed ordinance~origi~&~e&?with an application of Nr. Norman Cassell some
<br />months ago, for permission to build a coal chute under the sidewalk to his "Law Building" on
<br />High street, and a general ordinance to allow tunnelling under sidewalks has been u~der conside-
<br />ration o£ your Committee since said application.
<br /> We report our inabiiity~ so far, to perfect such an ordinance., .for~ lack of more
<br />formation on the subject, but pending the ~nactment of such an ordinance~ we recozmmend that Er.
<br />Norman Cassell be permitte~d to oonstr~ct a tunnel ~ft.ein. wide across the sidewalk of High
<br />street, reaching his property known as the "Law Building,~ in accordance with his plan for same
<br />submitted to this CommZttee; the work ~o ~e done under the supervision o£ the City ~ngineer,
<br />who shall supervise and approve of such work, notwithstanding any plan submitted therefor, and
<br />sh~I1 see that the construction of the tunnel s~ll be safe and of proper strength as to man-
<br />ner of construction and class of material for same.
<br /> We further recommend that Nr~ Norman Cassell shall gmve a personal bond ~to amount of
<br />SB~000.00, to be approved by the Council, to ind~mmify the ~ity against any damages from any
<br />so~rce whatever arising from said tunnel dnring its construction and maintenance. And he shall
<br />further give a written obligation to secure the City against any recovery of dama~s in excess
<br />of $8,000.O0; and the City shall reserve further the right to r~voke the privilege of said tun-
<br />nel or to require renewals of said bond and written obligation at any time i~ may deem proper
<br />t~ do so.
