<br />Commissioners of the City of Portsmouth begs leave to
<br />
<br />report to your honorable body that it, the said Board of Water Commissioners of the City of
<br />Portsmouth, instituted condemnation proceedings against the owner of a portion of the land named,
<br />for a municipad water works, and said proceedings were dismissed by ~Judge Lawless, of the Cir-
<br />cuit Court of Norfolk County, on the ground Shat such proceedings could ben.only prosecuted in
<br />the name of the City of Portsmouth, by direction of your honorable body, and as the general law
<br />requi~s that an effort~ should be made to acquire the land by purchase, before proceedings £or
<br />condemnation can be instituted~ the resolution now presented is for the purpose of directing
<br />the joint Finance Committee to ascertain if the same can be purchased, and for what price.
<br /> '~'~wing to the fact that the Board of Water Commissioners has, in the name of the City of
<br />PortsmOUth,~ contracted with the Eastern Dredzin~ Comoan~ of Greensboro North Ca~ol~ *~
<br />the construction of a canal from the Norfolk and Wester~Raimroad to L~ke Drurmr~ond, and the East-
<br />ern Dredging Company has about completed its barge and is erecting the maohinery~ ~nd ~xpects
<br />to start the actual ~onst~ction work by January 1st, it is necessary that the City should own
<br />the land through which its canal will be dug, or pay excessive damages to the Eastern D~edging
<br />Company.
<br /> "We, therefore, earnestly request that this resolution be speedily adopte~ by the Council.

<br />County, Virginia, and shown on the plan of land wanted by the City of Portsmouth, for a munici-

<br />a curve at Station SiT85.$, thence down the center line of a one degree curve to the left ~8.~
