~?'~-September:13~t994 <br /> <br />94-363 Letter from the City..Manager recommending adoption of <br />a resolution transferring certain City-owned property to the <br />Portsmouth Redevelopment and Housing Authority for conveyance <br />to Miller Day Nursery. <br /> <br /> "For some time, Miller Day Nursery has leased City owned <br />property (the former Robert E. Lee Elementary School) for use <br />as a day care facility. The Board of Directors of Miller Day <br />Nursery desires to obtain ownership of the property. They <br />propose to purchase the land and building for $1.00, but they <br />have agreed to pay to the City an amount equal to the real <br />estate tax assessment. The current annual taxis $1,465.07 for <br />both the land and the building. <br /> <br /> This facility is not required by the City for any current <br />or anticipated use. The Nursery is an asset to the community, <br />and with the annual payment of real estate taxes, I believe it <br />will be in the best interest of the community to sell the <br />property to Miller. <br /> <br /> Accordingly, I recommend that you adopt a resolution <br />transferring the site and building to the Portsmouth <br />Redevelopment and Housing Authority and that they arrange for <br />the sale of the property to Miller Day Nursery." <br /> <br />Councilman Johnny Clemons abstained from consideration and vote <br />of this item due to his being on the Board of Directors of <br />Miller Day Nursery. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Martin, <br />adopt the following resolution, and was adopted by the <br />following vote: <br /> <br />to <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY A <br />PARCEL OF REAL ESTATE LOCATED AT THE NORTHWEST INTERSECTION OF <br />DUKE STREET AND CAMDEN AVENUE TO THE PORTSMOUTH REDEVELOPMENT <br />AND HOUSING AUTHORITY. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia, that the City Manager be, and he hereby is authorized <br />to convey under such terms and conditions as the City Manager <br />shall deem to be in the best interest of the City of <br />Portsmouth, to the Portsmouth Redevelopment and Housing <br />Authority for development purposes, all that certain piece or <br />parcel of land designated as Parcel A on the "Minor Subdivision <br />Property of the City of Portsmouth (Map Book 4, page 45), and <br />adjoining (closed) portion of Race Street, (City ordinance <br />adopted 1/24/67 in Deed Book 1124, at page 495), of Portsmouth, <br />Virginia", dated August 3, 1994, made by Steven I. Boone & <br />Associates, P.C., Land Surveyors, which said plat is to be duly <br />recorded in the Clerk's Office of the Circuit Court of the City <br />of Portsmouth, Virginia." <br /> <br />Ayes: Griffin, Hawks, <br />Nays: None <br />Abstained: Clemons <br /> <br />Martin, Pitts, R°binett, Webb <br /> <br />94-364 - Letter from the City Manager recommending adoption of <br />a resolution requesting the Virginia Department of Game and <br />Inland Fisheries to authorize placement of "No Wake" signs in <br />portions of the Elizabeth River and Scotts Creek. <br /> <br /> "From discussions with several owners of marinas within <br />Portsmouth, it is apparent that there is a problem with boats <br />traveling at an excessive rate of speed, creating damaging <br />wakes and unsafe boating conditions. The State allows <br />localities to create ~'no wake" zones upon approval of an <br />application by the Virginia Department of Gsane and Inland <br />Fisheries. <br /> <br /> <br />
