= <br /> ' ~ september'27, 1994 <br /> <br /> 1. That.the use for which the hereinafter-described permit <br />sought: <br /> <br />(a) Will not adversely affect the health and safety of persons <br />residing or working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to <br />the property or ~mprovements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure <br />compatibility with surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a <br />plan for parking, driveways and curb cuts which will provide for <br />safe and convenient traffic movement; and <br /> <br />(e) Will be in accordance with the purposes of the City of <br />Portsmouth Zoning Ordinance. <br /> <br /> 2. That Port Norfolk Pentecostal Assembly is hereby <br />granted a use permit pursuan= to Section 40-43.1 of the Code of <br />the City of Portsmouth, Virginia, 1988, for the operation of a <br />church on property located at 353 Mt. Vernon Avenue and being <br />more particularly described as: <br /> <br />UP-94-12 <br /> <br /> Beginning at the northeastern intersection of Detroit <br />Street and Mt. Vernon Avenue; thence north along the eastern <br />right-of-way line of Mt. Vernon Avenue approximately 40 feet to <br />a point; thence east 140± feet to a point; thence north 40~ <br />feet along the western edge of a 15 foot alley to a point; <br />thence west 140± feet to a point; thence south 40± feet along <br />the eastern right-of-way line of Mt. Vernon Avenue to the point <br />of beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />(a) The building shall be used only as a church activities <br />facility for the applicant and shall not be employed to expand <br />the capacity of the applicant's sanctuary at 355 Mt. Vernon <br />Avenue. <br /> <br />(b) The applicant shall obtain a commercial reinspection of the <br />building and shall correct all deficiencies noted. <br /> <br />(c) The applicant shall install and maintain in good condition <br />any fire safety items required by the Fire Department including <br />emergency lights, fire extinguishers, exit lights and smoke <br />detectors. <br /> <br />(d) The occupant load of the first floor of the building shall <br />not exceed thirty-seven (37) people, and the occupant load of <br />the second floor shall not exceed ten (10) people. <br /> <br />(e) Alterations to the exterior of the building or to <br />property, which would adversely affect the residential <br />appearance of the property, are not permitted. <br /> <br />the <br /> <br />(f) If, within six (6) months of the issuance of the use <br />permit, the applicant shall fail to comply with all appliceble <br />building and environmental codes affecting the exterior of the <br />building, the use permit shall be revoked. <br /> <br /> <br />
