<br /> The regular reports of Officers for the month of March, 1915, were presented and were order-
<br />ed to tak~ the usual course.

<br /> The following opinion was read from the City Attorney as to rights of the S. A. L. Ry.
<br />at the southeast intersection of Water and County streets; and same was ordered to record.

<br /> "Replying to your request, received through the City Clerk, that I give you
<br /> my 'written opinion as to the rights of the S. A. L. Ry. Co. at the southeast intersection of
<br /> Water and County streets,' I beg to say:
<br /> "That by deed dated June l, 1880, recorded in the Clerk's office of the Court of Hustings
<br />for the City of Portsmouth in Deed Book 1E~ p.age 30~, the City of Portsmouth .conveyed this and
<br />other property to The Seaboard and Roanoke Ramlroad Company, in consideration of $30,000. But
<br />subsequently, by deed to W. & J. Parker, dated June E5, 1890, recorded in said Clerk's office
<br />in Deed Book El, page 46?, the Seaboard and Roanoke Railroad Company dedicated this property
<br />to the use of the public, using the following language:--

<br /> "The City has accepted the same by improvement of County street to the fence line of said
<br />Coi~pany and also by improvement of Water s~reet to the south line thereof.
<br /> "Hence I conclude, and it is my opinion, that the platform on said street is in violation
<br />of the law and can be removed should the City deem i~ such an obstruction as to require such
<br />action.

<br /> A communication was read from the City Attorney in which
<br />taken to the Supreme Court of Appeals of Virginia in the suit
<br />of Portsmouth; and the City Attorney was authorized to appeal
<br />
<br />he recommended that an appeal be
<br />of Ellis A. Jobson vs. the City
<br />said suit.
<br />
<br /> The Clerk ~atied attention to the fact that the Clerk of Market in his report for ~ar~
<br />notified the body that he had been ~abie to collect from Wade H. Codd rent of stalls in the
<br />City Market for the month of April, 1915.
<br /> On motion, the proper 0fficere were authorized to take steps for such coileo~ipn.
<br />
<br /> A communication was. read also from the President of the Seaboard Air Line Railway Co. in
<br />regard to the shifting of cars on Crawford street and to the smoke nuisance there.
<br /> He stated that said matters would be looked into and Council would hear from him again'as
<br />soon as practicable.
<br /> On motion of Mr. Herbert, the Clerk was instructed to write to the President of said
<br />Road and ask him to abate the nuisance complained of at once.
<br />
<br /> The Keeper of Cemeteries made the following report of lots and graves sold in the Oak Grove
<br />Cemetery during the month of March, 1915:
