October 25, 1994 <br /> <br />94-425 - Letter from the City Manager recommending adoption of a <br />resolution appointing viewers for the closing of a portion of <br />Bart Street. <br /> <br /> "An application has been filed with the Planning Department <br />for the closure of a portion of Bart Street. The Notice of <br />Application and Request for Appointment of Viewers has been <br />advertised. <br /> <br /> I, therefore, recommend the adoption of a resolution <br />appointing viewers for this application." <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Clemons, to adopt <br />the following resolution, and was adopted by the following vote= <br /> <br /> "A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF A <br />PORTION OF BART STREET IN THAT BLOCK BOUNDED BY AUGUSTA AVENUE <br />AND CAROLINE AVENUE. <br /> <br /> WHEREAS, Eldridge R. Vick has made application to vacate, <br />close and discontinue the hereinafter-described street, and it <br />appearing that Notice of Application and Request for an <br />Appointment of Viewers has been advertised as required by law. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that Roy Leinart, William Choate, <br />Clinton J. Fortune, Lee Batts and Casey Lavender be appointed <br />viewers and that Martha Glover and Otis Gene Baldwin be <br />appointed alternate viewers in the event that one of the <br />preceding viewers fails to participate, said viewers to view the <br />hereinafter described street and to report to this Council, in <br />writing, whether in their opinion, any, and if any, <br />inconvenience would result in vacating and closing the <br />following: <br /> <br /> ALL that portion of Bart Street from its intersection with <br />the eastern line of the right-of-way line of Augusta Avenue (as <br />extended across Bart Street) to the point where the extension of <br />the eastern boundary lines of Lot 17 in Block 57 and Lot 18 in <br />Block 46 on the plat of Virginia Realty and Investment Company <br />intersect the center line of the right-of-way of Bart Street, <br />said area being 120 feet, more or less, in length." <br /> <br />Ayes: Clemons, Griffin, Hawks, Pitts, Robinett, Webb <br />Nays: None <br />Abstained: Martin (because of his legal representation of one of <br />the adjoining property owners) <br /> <br />NEW BUSINESS <br /> <br />94-425 - Mr. Clemons offered the following nomination for <br />appointment to the following commission: <br /> <br />Plannin~ Commission <br /> <br />Robert C. Barclay, IV, to be reappointed to fill a term of four <br />years, commencing January 1, 1995. <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Pitts, t° close <br />the nominations, and there being no further nominations, the <br />above nomination was approved by unanimous vote. <br /> <br />94-427 Items Submitted by Council Members <br /> <br />(a) Councilman J~unes Martin requested a schedule of the CIP and <br />operating budget process by the next City Council meeting. <br /> <br /> (b) Mr. Orton co~ended William Jones, Director of Planning, and <br />his staff for successful work done on the River Pointe Project. <br /> <br /> <br />
