October 25, 1994 94-425 - Letter from the City Manager recommending adoption of a resolution appointing viewers for the closing of a portion of Bart Street. "An application has been filed with the Planning Department for the closure of a portion of Bart Street. The Notice of Application and Request for Appointment of Viewers has been advertised. I, therefore, recommend the adoption of a resolution appointing viewers for this application." Motion by Mr. Pitts, and seconded by Mr. Clemons, to adopt the following resolution, and was adopted by the following vote= "A RESOLUTION APPOINTING VIEWERS FOR THE CLOSING OF A PORTION OF BART STREET IN THAT BLOCK BOUNDED BY AUGUSTA AVENUE AND CAROLINE AVENUE. WHEREAS, Eldridge R. Vick has made application to vacate, close and discontinue the hereinafter-described street, and it appearing that Notice of Application and Request for an Appointment of Viewers has been advertised as required by law. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that Roy Leinart, William Choate, Clinton J. Fortune, Lee Batts and Casey Lavender be appointed viewers and that Martha Glover and Otis Gene Baldwin be appointed alternate viewers in the event that one of the preceding viewers fails to participate, said viewers to view the hereinafter described street and to report to this Council, in writing, whether in their opinion, any, and if any, inconvenience would result in vacating and closing the following: ALL that portion of Bart Street from its intersection with the eastern line of the right-of-way line of Augusta Avenue (as extended across Bart Street) to the point where the extension of the eastern boundary lines of Lot 17 in Block 57 and Lot 18 in Block 46 on the plat of Virginia Realty and Investment Company intersect the center line of the right-of-way of Bart Street, said area being 120 feet, more or less, in length." Ayes: Clemons, Griffin, Hawks, Pitts, Robinett, Webb Nays: None Abstained: Martin (because of his legal representation of one of the adjoining property owners) NEW BUSINESS 94-425 - Mr. Clemons offered the following nomination for appointment to the following commission: Plannin~ Commission Robert C. Barclay, IV, to be reappointed to fill a term of four years, commencing January 1, 1995. Motion by Mr. Clemons, and seconded by Mr. Pitts, t° close the nominations, and there being no further nominations, the above nomination was approved by unanimous vote. 94-427 Items Submitted by Council Members (a) Councilman J~unes Martin requested a schedule of the CIP and operating budget process by the next City Council meeting. (b) Mr. Orton co~ended William Jones, Director of Planning, and his staff for successful work done on the River Pointe Project.
