October 25, 1994 <br /> <br />5O5 <br /> <br />94-398 (j): <br /> <br /> Motion by Mr. Hawks, and seconded by Mr. Griffin, that <br />CA-94-21 be tabled, and was adopted by unanimous vote. <br /> <br />CONSENT AGENDA <br /> <br />94-398 - Resoning and group housing applications: <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Martin, to adopt <br />the following ordinances and resolution, approved on first <br />reading at the Public Hearing meeting on October 10, 1994, and <br />was adopted by the following vote: <br /> <br />94-398 (a): <br /> <br />"ZONING AMENDMENT ORDINANCE Z-94-07." <br /> <br />94-398 (b): <br /> <br /> "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE <br />PEP, MIT (GHP-94-3) RIVER POINTE ASSOCIATES, LLC, TO PERMIT <br />CONSTRUCTION OF TWENTY-FIVE (25) TOWI~-HOUSE UNITS. <br /> <br /> WHEREAS, the applicant, River Pointe Associates, LLC, has <br />made application pursuant to Section 40-112 of the Code of the <br />City of Portsmouth, Virginia (1988), as amended, for the <br />approval and granting of a group housing use permit for the <br />construction of twenty-five (25) town_house units at River <br />Pointe, on property more particularly described as follows: <br /> <br />GHP-94-3 <br /> <br />Beginning at the southwestern intersection of River Pointe <br />Parkway and River Pointe Drive; thence west along the southern <br />right-of-way line of River Pointe Drive approximately 774 feet <br />to a point; thence southeasterly 286.31 feet to a point; <br />thence southwesterly 54.82 feet to a point; thence <br />southeasterly 277.41 feet to a point; thence southwesterly <br />104.27 feet to a point; thence northwesterly 286.83 feet to a <br />point; thence northeasterly approximately 580 feet to the point <br />of beginning. <br /> <br /> WHEREAS, the Planning Co=~ission has reviewed such <br />application and site plan submitted therewith and has <br />recommended conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />the group housing project pursuant to Section 40-116 grants only <br />an exemption from certain requirements for residences as stated <br />in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning <br />Ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer and the applicant are aware that <br />building permits or any other required permit will be issued <br />only upon compliance with the ordinances, laws or regulations <br />applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> <br />
