November 22, 1994 <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br /> (a) The applicant shall comply with all applicable codes, <br />ordinances and regulations of federal, state and local <br />governments, and shall obtain all necessary licenses and <br />permits. <br /> <br /> (b) The facility shall be inspected annually by the City <br />Fire Department, Health Department and Building Inspections. <br /> <br /> (c) The applicant shall install smoke detectors in all <br />bedrooms, hallways and kitchens. <br /> <br /> (d) The applicant shall install six foot (6') stockade <br />fencing around the rear yard to buffer the single-family <br />residential uses. <br /> <br /> (e) Residents of the facility shall be limited <br />mentally or developmentally disabled residents, aged <br />(21) years or older. <br /> <br />to five (5) <br />twenty-one <br /> <br />(f) This use permit shall he non-transferable.,, <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />94-443 Letter from the City Manager recommending adoption of <br />a resolution authorizing the City of Portsmouth's 1995 <br />Legislative Proposals to be presented to the Portsmouth <br />Delegation for action in the 1995 General Assembly session, <br />deferred from the Regular Meeting on November 8, 1994. <br /> "Attached for your consideration are the draft 1995 <br />Legislative Proposals. State Aid for Public Libraries <br /> <br />EFFECTIVE GOVERNMENT REQUESTS INCLUDE: <br /> <br /> 2. <br /> 3. <br /> 4. <br /> 5. <br />Covers <br /> 6. <br /> 7. <br /> <br />State Study on Juvenile Status Offenders <br />State Mandates <br />Reimbursement for Expenses for DUI Convictions <br />Amendment to State Code to Prohibit Loitering <br />Amendment to State Code to Prohibit the Use of Car <br /> <br />Removal of Abandoned Structures and Buildings <br />Amendment to State Code to Authorize Localities to <br /> <br />Recover Costs From Any Dangerous or Negligent Situation <br /> <br /> There are 10 items that will be monitored closely because <br />of their potential fiscal impact if adopted by the Legislature. <br />Please note that the recommendations suggested by City Council <br />from the Public Work Session on Monday, November 7, 1994 have <br />been incorporated. I have also attached information requested <br />on the funding options as presented by the Virginia Department <br />of Transportation on November 8, 1994. <br /> <br /> I recommend approval of the Draft 1995 Legislative <br />Proposals." <br /> <br /> <br />
