November 22, 1994 <br /> <br />94-433 (c): <br /> <br /> "AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, ~IRGINIA (1988), BY AMENDING SECTION 40-$2.3(C) <br />THEREOF, PERTAINING TO CONVERSION DWELLING UNITS IN HISTORIC <br />DISTRICTS." <br /> <br />94-433 (d) <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT TO JOYCE DEHAUSE TO <br />CONVERT 415-419 COURT STREET INTO A TRIPLEX. <br /> <br /> WHEREAS~.Joyce DeBause, has made application pursuant to <br />Sections 40-43.1 and 40-52.1 of the Code of the City of <br />Portsmouth, Virginia (1988), for the granting of a use permit to <br />convert the residential structure at 415-419 Court Street, <br />Portsmouth, Virginia, into a triplex, as hereinafter-described; <br />and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the permit hereinafter <br />described is sought: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing or working in the neighborhood of the <br />proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious <br />to the property or improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure <br />compatibility with surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to <br />a plan for parking, driveways, and curb cuts which will provide <br />for safe and convenient traffic movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City <br />of Portsmouth Zoning Ordinance. <br /> <br /> 2. That Joyce DeBause is hereby granted a use permit <br />pursuant to Sections 40-43.1 and 40-52.1 of the Code of the City <br />of Portsmouth, Virganma (1988), to convert the residential <br />structure located at 415-419 Court Street into a triplex, and <br />being more particularly described as: <br /> <br />UP-94-14 <br /> <br /> Beginning at the northeast intersection of London Boulevard <br />and Court Street, thence north 43 +/- feet along the eastern <br />right of Court Street to a point of beginning; thence in an <br />easterly direction 88+,/- feet to a point; thence in a northerly <br />direction 62 +/- feet to a point; thence in a westerly direction <br />88+/- feet to a point; thence in a southerly direction 62 +/- <br />feet to the Point of Beginning. <br /> <br /> <br />
