<br /> "Your undersignsd, who .~ere appointed m committee to investigate cer'tain charges
<br />filed with the ~ayor of the City of Portsmouth against Mes~rs~ C~ H. Herbert, Ch~irma~ of the
<br />Department of Finance and L. P. Slater, Clerk of the City Council, amd i~cidentally involving
<br />the entire Council, respectfUdly report ms follows:

<br />W. C~ Corbitt, Chairman of said committe~o That subsequent to~saidor~animation you~ c~mmlt~e
<br />caused notices to be issued to Messrs. James A. Nulvey, C. H. ~erbert~ Chairman of the ~epar~-
<br />ment of Finance of the City Council a~d L. P. Slater, Clerk of the City Council, advising said
<br />gentlemen that the commission would hold a session for the hea~ing of Sm~d charges on the ninth
<br />day of Narch, igly, at eight o'otoc~ P. No at the 0ouncil Chamoer o£ T~he~l~y of Portamouth,
<br />Virginia, and requestinE that said gentlemen should produce such witnesses as they deemed neces-
<br />sary for the fullest investigation of said~charges.

<br /> · n~ pursuant to said notice, at the time and plmce last above-mentioned, your committee
<br />met and the &foresaid gentlemen were present, mhd the Chmirm~n of the commission called upon Mr,
<br />Jmmes A. Mulvey ~o submit whatever facts he may h~ve bearing upon.the said charges. Mr. Jmmes
<br />A~ Nulvey then proceeded to testify with reference to the allegations contained in his mfore-
<br />said charges, m copy of which testimony, as reported in full by the stenographer in at~endanc-e,
<br />is herewith ~ppended and asked to be resxl as a part of this report'.

<br /> "It will be noted by a perusal of the testimony that considerable latitude was allowed the
<br />smid James A. Eulvey in the matter o£ testimony~ and much ~f what miF~t be p~operly deemed here-
<br />say evidence was sxlmitted~ Your commission permitted the intzoductionof this evidence for the
<br />reason that it felt, while this was a proceeding with reference to theinvestigation of formml
<br />chmrges, yet it involved the acts of public officials with reference $o the disch~ge~f~pig~!$o
<br />dutieS, and that being ~rue your commission felt that thefuilest and frankest investigation
<br />possible consistent with justice ~hould be permitted.

<br /> ,After Mr. Eutvey had submitted his oral testimony, togethe~ ~ith. oert~in exhibits, in t~e
<br />way Of letters ~nd references to the minutes of'mthe meetings' of th~:i~ouncil, which letters
<br />minutes have been incorporated in the stenographic reOor~ above referred to, ~r. L. P. Slater
<br />answered the charges so far ms he deemed necessary, ~ report of his testimony being likwise in-
<br />corporated in the stenographic reoo~d above'referred to; Mr. L. C. Brinson was called upon by
<br />Mr. James A. Mulvey to answer certain questions with reference to the actions Of the Council,
<br />a~d Mr. L. C. Br~nson made m statement concerning the m~tters in controversy, which statement
<br />is also incorporated in full in the stenog~mphio record above referred tO.

<br />invited to submit such n~me~ as th~y. might/desire to h~ve for witnesses, mhd to cmll for ~uCh
<br />records, books s~ud other papers of the'Council a~ they dee~ed expedient.

<br /> "Your commission further reports that after the hearing of the said charges on the ninth
<br />day of ~arch, 1917, ms aforesaid, your commission through its Chairman, then mdvised all parties
<br />to the within controversy thmt the hearing would be held open for a period of two ~ays from the
