<br />of the Peace, and the High Constable and his deputies.

<br /> ~Hence, we find that the Council, the Attorney for the Commonwealth, the City Treasurer,
<br />the City Sergeant, ,ne Commissioner of the .Revenue, 'and the Clerk of the Courts e~ve elected
<br />by the people, so required by the Constitution of the State.
<br />
<br /> ~Th~t the City Collector, City Auditor, City Attorney, the Civil and Police Justice, the
<br />Justices of the Peace, and the Hi~hConstable are elected by the Council, as required-by Sec-
<br />tion 8 of the said Act, the same in that respect not being modified by or inconsistent with
<br />Section 6-c of the City Manager plan.

<br /> ~The Judges of our Courts are ~iected by the General Assembly, as provided by the Consti-
<br />tution of the State,
<br />
<br /> MAll other officers a~d employees, so far as we can now recall, except, the deputies to
<br />the officials above mentioned who are appointed by said officials, with the approval of the
<br />proper authority, are appointed and removed by the City Nauager; but the City Manager shall re-
<br />port each appointment and removal to the'Council at the next meeting thereof following any such
<br />appointment or removal.

<br /> ~ith regard to the Heads of Departments, it is ou~ opinion that they act simply as com-
<br />mittees to the Council, to whom should be referred such mmt~ers as should properly come before
<br />the Council for legislative action; certain it is that they have no power, nor has the Council
<br />amy except by proper ordinance, to interfere with the admini-strative and executive powers of
<br />the ~it~, ~ich is solely vested, by the Act, in the City Manager.
