Au,qust 27, 2002 <br /> <br /> (a) The group housing project shall be limited to two buildings, each with <br />three units. The total number of units shall not exceed six townhouse units with each <br />unit encompassing a minimum of 1,360 square feet. The Director of Planning and <br />Inspections is authorized to approve minor modifications to the submitted site plans. <br /> <br /> (b) A site plan showing driveways, landscaping and setbacks must receive <br />approval from the Director of Planning and Inspections prior to the filing of any <br />application for or approval of any building permit. <br /> <br /> (c) A minimum of twelve on-site parking spaces must be provided. One of the <br />parking spaces must be reserved for persons with disabilities. <br /> <br /> (d) The applicant and any successor in interest shall comply with all <br />applicable statutes, ordinances, and regulations of federal, state and local government <br />and shall obtain and maintain in effect all required permits. <br /> <br />(e) All taxes in connection with the subject property shall be paid when due. <br /> <br /> 3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />02 - 260 - Adoption of an ordinance to amend Chapter 22 of the Code of the City of <br />Portsmouth to establish a process for regulating the operators and owners of unsafe <br />and overweight vehicles found operating on City streets. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to amend Chapter 22 of the Code of the City of <br />Portsmouth to establish a process for regulating the operators and owners of unsafe <br />and overweight vehicles found operating on City streets. <br /> <br />Purpose and Need: <br /> <br />· The City of Portsmouth receives a high volume of truck traffic generated by activities <br />at the region's ports and other commercial and industrial establishments. <br /> <br />· Overweight and otherwise unsafe trucks pose a danger to citizens and damage the <br />roads of the communities through which they pass. <br /> <br />· State Code allows the City of Portsmouth to establish a motor carrier safety program <br />that would permit the City to seek civil fines against the operators and owners of <br />overweight vehicles and to remove from the roads any unsafe trucks that cannot be <br />made safe. <br /> <br />· While the assurance of public safety is the primary purpose of the ordinance, the <br />Sheriff reports that the cities of Virginia Beach and Chesapeake each collected civil <br />fines in excess of $1 million last year. <br /> <br />· It is anticipated that both the Office of the Sheriff and the Police Department will <br />operate motor carrier safety programs. <br /> <br /> <br />
