<br /> ~T H i S C 0 N T R A C T made this 8th day of October, 1918, between the CI~i~£ 0P PORTS-
<br />MOUTH,--a~t~n~ b~ ~n~'~o~g~ The council of the City of PortSmouth, and the COUNTY OF NORFOLK,
<br />acting by and through the Boar~ of ~apervisors of the County of Norfolk, parties of the first
<br />p~rt; the ~S C0~¢P~d~f, INCORPORATED, A 6orporation oreantzed and e~isting under the laws
<br />of Virgir~i~, hereinafter called the Ferries Company, party of the second Dart, and the [[NITED
<br />S ~TA~S of ~IGA, acting by T~ BUREAU OF I~UDUSTRIAL HOUSING AND TRANSPORTATION OF THE DE-
<br />p;_RT~-T_ OF LABOR, tinder the authority of the President and the Secretary of Labor, hero,after
<br />called The Bureau, party of the third part, witnesseth:
<br /> WBY~REAS, it is desired by all parties hereto that The Bureau, on behalf of the United
<br />States Government, take over the operation of the Norfolk County Ferries; and
<br /> ~F~S, it is necessary, in connection therewith, that the present lease of the said Fer-
<br />ries, now held by the party of the second part, should be terminated as of the time that the
<br />operation of said ferries is taken over by The Bureau.
<br /> N0~, T~0RE, in consideration of the mutual promises and covenants in tP~is agreement
<br /> contained, it is agreed by and between the parties hereto, as follows:
<br /> FIRST: That by and with the mutual consent of the parties ~f the first and second_parts,
<br />hereto,--~e said lease of the Norfolk County Ferries, executed by the-City of PortSmouth and
<br />by the County of Norfolk and now held by the Ferries Company, dated Narch Sl, 1909, shall
<br />terminate as of the time that The Bureau shalt take over the operation of said ferries, in
<br />same manner and to th~ same effect as if such time b~d been originally fixed in said lease as
<br />the time for the te~nination thereof;
<br /> SEC0~: That the appraisal of the ferries' properties, so provided for in said lease,
<br /> shall t--{-~-~--place as of the time that the ferries shall be taken ove~ by ~he Bureau instead of
<br /> at the regular termination of the said lease, as therein proviaed and said appraisal sP~all be
<br /> made in the same manner as if the said lease had regularly tez~_nated at the date that the said
<br /> ferries are taken over by The Bureau, as aforesaid.
<br /> THIRD: That should any money be due the Ferries Cc~pany by the City of Portsmouth and
<br /> the-Oo--~ of Norfolk, as a result of the said appraisal mentioned above, then such amount shall
<br /> be paid to the Ferries C~any by The Bureau and ctmrged ~y-it to the City of Portsmouth and
<br /> the County of Norfolk, as provided under the agreement with them, of even date herewith; and if
<br /> any moneys shall be due the City of~ Portsmouth-and the County Of Norfolk by the Ferries Company
<br /> as a result of said appraisal, then the Ferries CoL-puny shall pay such amount to The Bureau
<br /> instead of paying s~me to the City of Portsmouth s~d the. County of Norfolk', and The Bureau shall
<br /> credit the City of Portsmouth and the County of Norfolk ~erewith, as provided in its agreement
<br /> with them, of even date herewith.
<br /> FOD~_~: It is specifially understood, however, that all leases made h~y the party of the
<br /> secon~ to sub-tenants for siores and stands shall for~ the period of tD~ original l~ase,
<br /> tb~t as, until April_,~- 1919., be binding.__ on the part,es of the fzrst par~ and the partzes~ of
<br /> the first part shall be entitled to ail Tents and other prell.ts accruing ~t_herefr0_m_=.f.ter. .the
<br /> date that The Bureau takes over the ferries, as aforesaid, which sums shall be eo±±eeme~ oy
<br /> The Bureau, as part of the receipts of the ferries, as provided in the contract between i~ and
<br /> the parties of the first part of even date herewith.

<br /> its n~me and on its behalf by J. T. Han~ey, the President of the ~ou_ueil of the Cmty of Ports-
<br /> mouth and its Corporate. Seal to be hereunto affixed, attested lny L. CA Bri~son, Clerk of said
<br /> Council, tlaereunto duly aut~ormzed by resolution of said C~o3acil passed on October 10th, 1918,
<br /> and the County of Norfolk has caused this instrument to be exe~ted in its~ name and on its be-
<br /> half b~ ~. H. Rod~an, the Chairman of the Board of Su~rvisors of the Cottuty of Norfolk and the
<br /> seal of said Board of Supervisors to be hereunto affixed, attested by Go Tayloe'Gwathmey,-Clerk
<br /> of said Board of Supervisors, thereu~uto duly authorized by resolutiOn of said Board passed 0c-
