<br />FebrUary 7, 1995, there were present:

<br /> Mayor Gloria O. Webb, *Vice Mayor Johnny M. Clemons,
<br />Bernard D. Griffin, Sr., James C. Hawks, James T. Martin,
<br />Cameron C. Pitts, *P. Ward Robinett, Jr,, V. Wayne Orton, City
<br />Manager, Stuart E. Katz, City Attorney.

<br />95-54 - The following call for the meeting was read:
<br />
<br /> '~lease attend a called meeting of the City Council to be
<br />held in the City Council Chamber, 6th ifloor, City Hall Building,
<br />801 Crawford Street at 4:00 p.m., Tuesday, February 7, 1995, for
<br />the purpose of discussion and consideration of a resolution
<br />pertaining to the Crawford Square Garage and the Crawford Square
<br />Condominiums, a motion pertaining to the Sleepy Hole Golf
<br />Course, and a Public Work Session on the CIP.
<br />
<br /> In addition, you may consider a motion to go into an
<br />ExeCutive Session.
<br />

<br />CITY MANAGER'S REPORT -
<br />
<br />95-56 - Letter from the City Manager recommending adoption of a
<br />resolution~author~zing the ~ity Manager to,enter into such deeds
<br />as may be appropriate to correct the boundary line between the
<br />CrawfordSquareGarage and the Crawford Square Condominiums.
<br />
<br /> "Surveys and recent title examinations reveal that the
<br />boundary line between the Crawford Square Garage and the
<br />property on which~the Crawford Square Condominiums are located,
<br />was corrected by a plat. They also reveal that deeds have never
<br />been executed between the parties to ensure that title to these
<br />properties conforms to the subdivision plat. Deeds are now
<br />necessary in order to ensure that fee simple title to each
<br />property rests with the proper party.

<br /> I, therefore~ recommend adoption of this resolution in
<br />order t01enter into such deeds as may be necessary to ensure fee
<br />simple title to thelproperty, of the POrtsmouth Parkside
<br />Development Associates and the City."

<br /> MOtion by Mr, Hawks, and seconded by Mr. Pitts, to adopt
<br />the following resolution, and was adopted by the following vote:
<br />
<br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO
<br />SUCH DEED{S) AS MAY BE NECESSARY TO CORRECT THE BOUNDARY LINE
<br />ADJACENT TO THECRAWFORD SQUARE GARAGE.
<br />
<br /> WHEREAS, the City of Portsmouth acquired Disposition
<br />Parcels 28{B) and 28{C) on the plat showing Parcels 28(A), 28(B)
<br />and 28(C), Crawford Urban Renewal Project VA,R-53, duly recorded
<br />in the Clerk's Office of the Circuit Court of the City of
<br />Portsmouth, Virginia, in Map Book 13, at page 196; and
<br />
<br /> WHEREAS, Portsmouth Parkside Development Associates
<br />acquired Parcel 28(A)i on the aforementioned plat, which said
<br />parcel is located immediately to the north of and adjacent to
<br />those parcels belonging to the City; and
<br />
<br /> WHEREAS, the City and Portsmouth Parkside Development
<br />Associates entered into plat entitled "Subdivision of Property,
<br />Parcels 28(A), 28(B) and 28(C), plats showing survey of
<br />Disposition Parcels 28(A), 28(B) and 28(C), Crawford Urban
<br />Renewal Project VA-R-53", which said plat is duly r~corded in
<br />the aforementioned Clerk's Office in Map Book 14, at page 181,
<br />and which said plat adjusts the boundary line between the
<br />parties; and
