<br /> ~ne following contract, which hag b~en tabled August 12th~ was taken up, read, adopted,
<br />~nd the proper Officers authorized to sign same:

<br /> "This Contract made this day of August, 1919, between the City of Portsmouth, Va.,
<br />a munze~pal Corporation, exis~der the laws of the State of Virginia, parties of the first
<br />cart and hereinafter called the City, and Jerome P. Cart, a citizen of Norfolk County, Virginia,
<br />~arty of the second part.'

<br /> '~Widereas the City has purchased a tract o~ land on the West side of Bains Creek and desig-
<br />nated as Olive'Braneh Cemetery and,
<br />
<br /> ~V~hereas the City has ~onsidered the erection of a bridge across Bains Creek from the end
<br />of High St. extene, z.ng to. 0lave B. ranch .Cemetery, out on account, of the party o~ the s c?nd p rt
<br />objecting to the travelzng publac passzng east and north of h~s property line located oetween
<br />King and High St. ext~ndzng to B~ir~ Creek, and on the east bar2< thereof, and

<br /> "V~b_ereas it would be necessary to cross the riparian rig!%ts o~ the party of the second
<br />part in Bains Creek in order to construct a bridge from. the w~st end of King St. to the Olive
<br />Branch Cemetery in a northwesterly direction as shown on plat hereto attached.

<br /> "Now therefore the City hereby agrees to construct a bridge for the use of the general puD-
<br />lic across Balms. Creek in a northwesterly direction begirming at the west end of King St. and
<br />landim~ at a point of land on the northeast corner of said Olive Branch Cemetery. Said bridge
<br />to be built by the City of Portsmouth in such a ~znqer and at such times as the City of Ports-
<br />mouth may designate.

<br /> ":~ue paPty of the seco~l part agrees to dedicate to the City of Portsmouth, such right,
<br />title and interest as may be necessary for the erection of said bridge where the same crdsses
<br />the rSparian rights of the party of the second part, these rights Deing dedicated to the city
<br />for and in consideration of the City agreeing not to construct the said bridge ~rom the west
<br />end of High St. extending to the cemetery site and it is feather agreed that the right of the
<br />City to cross the riparian right may remain in full force and effect so long as said bridge
<br />is constructed and operated fram the west end of King st.
