July 30, 2002 <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That New Mt. Olivet Baptist Church is hereby granted a use permit pursuant <br />to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate a <br />religious facility based child care center (S.I.C. 835) at 1000 County Street, and being <br />more particularly described as: <br /> <br />UP-01-25 <br /> <br />Beginning at the northwest corner of the intersection of <br />County Street and Phoebus Street; thence, east 352'+ to a <br />point; thence, north 230'+ to a point; thence, west 350"+ to a <br />point; thence; in a southerly direction 230'+ to the point of <br />the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br /> (a) Occupancy of the facility shall be limited to 50 school age children aged <br />2 1/2 years to sixth grade. <br /> <br /> (b) Approval of the outdoor play area and fencing must be received from the <br />Downtown Design Committee. <br /> <br /> (c) The indoor hours of operation shall be from 6:30 a.m. to 6:00 p.m., <br />Monday through Friday. <br /> <br /> (d) <br />6:00 p.m. <br /> <br />Outdoor hours of operation shall be limited to between 10:00 a.m. and <br /> <br /> (¢) The facility shall be subject to all required inspections by the City's Fire <br />Department Bureau, Health Department, and Building Official. Inspections shall include <br />an initial inspection prior to occupancy and annual inspections thereafter. <br /> <br /> (f) The facility shall comply with all applicable local, state and federal <br />regulations including the conduct of required inspections and the maintenance of <br />necessary licenses. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />02-210(c): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO COLONIAL FOODS, L.L.~., FOR <br />THE OPERATION OF A RESTAURANT AT 4032 VICTORY BOULEVARD. <br /> <br /> WHEREAS, Colonial Foods, L.L.C., has made application pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use <br />permit for the operation of a restaurant at 4032 Victory Boulevard, Portsmouth, Virginia; <br />and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br /> <br />
