July 30, 2002 (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That New Mt. Olivet Baptist Church is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) to operate a religious facility based child care center (S.I.C. 835) at 1000 County Street, and being more particularly described as: UP-01-25 Beginning at the northwest corner of the intersection of County Street and Phoebus Street; thence, east 352'+ to a point; thence, north 230'+ to a point; thence, west 350"+ to a point; thence; in a southerly direction 230'+ to the point of the beginning. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) Occupancy of the facility shall be limited to 50 school age children aged 2 1/2 years to sixth grade. (b) Approval of the outdoor play area and fencing must be received from the Downtown Design Committee. (c) The indoor hours of operation shall be from 6:30 a.m. to 6:00 p.m., Monday through Friday. (d) 6:00 p.m. Outdoor hours of operation shall be limited to between 10:00 a.m. and (¢) The facility shall be subject to all required inspections by the City's Fire Department Bureau, Health Department, and Building Official. Inspections shall include an initial inspection prior to occupancy and annual inspections thereafter. (f) The facility shall comply with all applicable local, state and federal regulations including the conduct of required inspections and the maintenance of necessary licenses. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." 02-210(c): "A RESOLUTION GRANTING A USE PERMIT TO COLONIAL FOODS, L.L.~., FOR THE OPERATION OF A RESTAURANT AT 4032 VICTORY BOULEVARD. WHEREAS, Colonial Foods, L.L.C., has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit for the operation of a restaurant at 4032 Victory Boulevard, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions.
