July 30, 2002 <br /> <br />UP-02-08 <br /> <br />Beginning at the northwest corner of the intersection of <br />Portsmouth Boulevard and Chippewa Trail; thence, south <br />140'+ to a point; thence, west 70'+ to a point; thence, north <br />138'+ to a point; thence, east 70'+ to the point of the <br />beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which shall <br />be observed by the applicants and any successor in interest: <br /> <br /> (a) Occupancy of the facility shall be limited to four children under the age of <br />2 1/2 years and 18 children aged 2 1/2 years and older. <br /> <br /> (b) The hours of operation shall be from 6:00 a.m. to 6:00 p.m., Monday <br />through Friday. <br /> <br /> (c) <br />p.m. <br /> <br />Outdoor hours of operation shall be limited to between 8:00 a.m. and 6:00 <br /> <br />(d) Drop-off and pick-up of children shall be from the rear of the facility. <br /> <br /> (¢) A plan for storage and removal of refuse must be approved by the <br />Department of General Services prior to commencement of operations. <br /> <br /> (f) The facility shall comply with all applicable local, state and federal <br />regulations including the conduct of required inspections and the maintenance of <br />necessary licenses. <br /> <br /> (g) A site plan approved by the Director of Planning shall be implemented <br />prior to occupancy. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />02-210(b): <br /> <br />"A RESOLUTION AMENDING A USE PERMIT GRANTED TO NEW MT. OLIVET <br />BAPTIST CHURCH TO OPERATE A RELIGIOUS FACILITY BASED CHILD CARE <br />CENTER AT 1000 COUNTY STREET. <br /> <br /> WHEREAS, on January 8, 2002, applicant New Mt. Olivet Baptist Church was <br />granted a use permit to expand and operate a religious facility based child care center <br />(S.I.C. 835)for 23 children at 100 County Street, Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant now desires an amendment to that use permit to <br />expand the facility's capacity to 50 children over the age of 2 1/2 years; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> <br />
