July 30, 2002 UP-02-08 Beginning at the northwest corner of the intersection of Portsmouth Boulevard and Chippewa Trail; thence, south 140'+ to a point; thence, west 70'+ to a point; thence, north 138'+ to a point; thence, east 70'+ to the point of the beginning. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicants and any successor in interest: (a) Occupancy of the facility shall be limited to four children under the age of 2 1/2 years and 18 children aged 2 1/2 years and older. (b) The hours of operation shall be from 6:00 a.m. to 6:00 p.m., Monday through Friday. (c) p.m. Outdoor hours of operation shall be limited to between 8:00 a.m. and 6:00 (d) Drop-off and pick-up of children shall be from the rear of the facility. (¢) A plan for storage and removal of refuse must be approved by the Department of General Services prior to commencement of operations. (f) The facility shall comply with all applicable local, state and federal regulations including the conduct of required inspections and the maintenance of necessary licenses. (g) A site plan approved by the Director of Planning shall be implemented prior to occupancy. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." 02-210(b): "A RESOLUTION AMENDING A USE PERMIT GRANTED TO NEW MT. OLIVET BAPTIST CHURCH TO OPERATE A RELIGIOUS FACILITY BASED CHILD CARE CENTER AT 1000 COUNTY STREET. WHEREAS, on January 8, 2002, applicant New Mt. Olivet Baptist Church was granted a use permit to expand and operate a religious facility based child care center (S.I.C. 835)for 23 children at 100 County Street, Portsmouth, Virginia; and WHEREAS, the applicant now desires an amendment to that use permit to expand the facility's capacity to 50 children over the age of 2 1/2 years; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood;
