O38 <br /> <br />March 13, 1995 <br /> <br /> Motion by Mr. Martin, and seconded by Mr. Pitts, to <br />approve the use permit application. <br /> <br /> Motion by Mr. Hawks, and seconded by Mr. Robinett, to <br />amend the motion to add two additional conditions: I. The use <br />permit will be non-transferable; 2. There will be no crushing <br />of vehicles on the site, and was adopted by unanimous vote. <br /> <br /> The -amended m~%ion was ~ adopted by a vote of 6-0 on <br />first reading. <br /> <br />(d) UP-95-05 <br /> <br />CAVALIER MANOR NEIGHBORHOOD - Request of Hattie <br />G. Walker for a use permit to operate a day care <br />center at 509 Truman Circle. <br /> <br /> Motion by Mr. Hawks, and seconded by Mr. Griffin, to defer <br />consideration of UP-95-05 until the Regular Meeting of May 8, <br />1995, and was adopted by a vote of 6-0. <br /> <br />(e) UP-95-06 <br /> <br />CHURCHLAND NEIGHBORHOOD - Request of Kimberlee <br />Mack-Wiggins to operate an adult residential <br />care facility at 5857 Trucker Street. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Martin, to concur <br />with the recommendation of the Planning Commission that <br />UP-95-06 be approved on first reading, and was adopted by a <br />vote of 6-0. <br /> <br />(f) CA-95-02 <br /> <br />CITY CODE AMENDMENT - A Zoning Ordinance <br />amendment to define and establish minimum unit <br />living area exclusive of garage and patio <br />dimensions for residential zoning districts in <br />Table 40-44.1 Dimensional Requirements: <br />Residential Zoning Districts and revising other <br />related sections of the code such as Definitions <br />section. The a/nendment will also add Yard <br />requirements to Table 40-44.2 for the RS-85 <br />district. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Griffin, to <br />concur with the recommendation of the Planning Commission that <br />CA-95-02 be approved on first reading, and was adopted by a <br />vote of 6-0. <br /> <br />(g) CA-95-03 <br /> <br />CITY CODE AMENDMENT - A zoning ordinance <br />amendment to add to Table 40-44.1 a definition <br />of "floor area in unit" as exclusive of garage <br />and patio for the Single Fsanily RS-85 district <br />and also, adding Yard Requirements to Table <br />40-44.2 for the RS-85 district. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Martin, to <br />permit the withdrawal of the request for approval of CA-95-03, <br />and was adopted by a vote of 6-0. <br /> <br />On motion meeting was adjourned at 8:33 p.m. <br /> <br />Gloria O.
