O38 March 13, 1995 Motion by Mr. Martin, and seconded by Mr. Pitts, to approve the use permit application. Motion by Mr. Hawks, and seconded by Mr. Robinett, to amend the motion to add two additional conditions: I. The use permit will be non-transferable; 2. There will be no crushing of vehicles on the site, and was adopted by unanimous vote. The -amended m~%ion was ~ adopted by a vote of 6-0 on first reading. (d) UP-95-05 CAVALIER MANOR NEIGHBORHOOD - Request of Hattie G. Walker for a use permit to operate a day care center at 509 Truman Circle. Motion by Mr. Hawks, and seconded by Mr. Griffin, to defer consideration of UP-95-05 until the Regular Meeting of May 8, 1995, and was adopted by a vote of 6-0. (e) UP-95-06 CHURCHLAND NEIGHBORHOOD - Request of Kimberlee Mack-Wiggins to operate an adult residential care facility at 5857 Trucker Street. Motion by Mr. Pitts, and seconded by Mr. Martin, to concur with the recommendation of the Planning Commission that UP-95-06 be approved on first reading, and was adopted by a vote of 6-0. (f) CA-95-02 CITY CODE AMENDMENT - A Zoning Ordinance amendment to define and establish minimum unit living area exclusive of garage and patio dimensions for residential zoning districts in Table 40-44.1 Dimensional Requirements: Residential Zoning Districts and revising other related sections of the code such as Definitions section. The a/nendment will also add Yard requirements to Table 40-44.2 for the RS-85 district. Motion by Mr. Robinett, and seconded by Mr. Griffin, to concur with the recommendation of the Planning Commission that CA-95-02 be approved on first reading, and was adopted by a vote of 6-0. (g) CA-95-03 CITY CODE AMENDMENT - A zoning ordinance amendment to add to Table 40-44.1 a definition of "floor area in unit" as exclusive of garage and patio for the Single Fsanily RS-85 district and also, adding Yard Requirements to Table 40-44.2 for the RS-85 district. Motion by Mr. Robinett, and seconded by Mr. Martin, to permit the withdrawal of the request for approval of CA-95-03, and was adopted by a vote of 6-0.
