' 061' ~ March 28, 1995 WHEREAS, Stanley A. Holmes has made application on behalf of Holmes Brothers Auto, Inc., pursuant to Section 40-43.1 of the Coda of the City of Portsmouth, Virginia (1988) for the granting of a uSe permit to operate an auto stripping facility {S.I.C. 5015) at 1821 County Street, Portsmouth, Virginia, as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things reqUired to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOw, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the hereinafter-described permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Holmes Brothers Auto, Inc., is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of an auto stripping facility (S.I.C. 5015) on property located at 1821 County Street, and being more particularly described as: UP-95-04 Beginning at a point 116'± south of the southeast corner of the intersection of County Street and Yorktown Avenue; thence, south 179'± to a point; thence, in an southeasterly direction 205'± to a point; thence, north 124'± to a point; thence, east 6'± to a point; thence, north 48'± to a point; thence, west 100'± to a point; thence, north 47'~ to a point; thence, 102'± to the beginning. 3. That this use permit is approved subject to the following conditions: (a) No on-site crushing of motor vehicles shall be permitted. (b) The applicant shall comply with all applicable codes, ordinances and regulations of federal, state and local governments and shall obtain and maintain in effect all necessary licenses and permits.
