J~nu~=Y 10~ 192~ ber~31st, was taken up and read: AN ORDINANCE TO CLOSE AND DISCONTINUE TMOMAS AVENUE AS IT IS LAID OUT IN THE ,PLAT OF LANDS AT PtNNERS-POINT, NORFOLK COUNTY, VIRGINIA, PURCHASED BY T: J. WOOL, H. L. MAYNARD, AND A. J. PHILLIPS, FROM EMELINE THOMAS, AND OF LAND OWNED BY EMELINE THOMAS," OF RECORD IN THE CLERK'S OFFICE OF THE CIRCUIT COURT OF NORFOLK1 COUNTY, IN NAP BOOK 5, PAGE 56. The City Attorney gave hie verbal opinion~that the Council has a right to close said avenue, and the City Manager stated that he had investigated The matter and recommended the passage of the ordinance. Then Mr. Esleeck moved that the ordinance be adopted, and it was adopted ~y the fol- lowing vote: Ayes-- Brooks, Esleeok, Cast, Smith, White, 5. On moti=n of Mr. Esleeck, action on the proposed amendments to the two Jitney Ordinances, which had been plak.ed on their first reading by Council December 27th, and the Ordinance re- pealing section 6 of Ordinance Creating the Office of Sealer of Weights & Measures for the City of Portsmouth, which had ~lso been placed on ~ts first reading December 27th,~was~deferre~ until the next regular meeting of Council. The regula~ reports of the City Clerk & Auditor, City Collector and City Treasurer for the month of December were presented and referred to the Finauce Committee. The follow%nE communication from the City Attorney was referred to the Finance Committee: "Portsmouth, Va., Jmnuary loth, 1922 Hon. City Council, Portsmouth, Va. Gentlemen:~ At your last meeting t was directed ~o file exceptions in the condemnation cases concerning the extension of Hatt~n Street. I have filed the exceptiOnS as directed, but should the Court set aside the previous award it c~n only appoint new commissioners whose appraisal might be more or less than the amount appropriated. I h~ve been info,ed b~the owners that they are willing to pay into Court the difference between the $30,O00~OO to be paidby the City and the $32,5~O.O~awarded by the Commissioners. A request of the School Board that $6,763.01 be made available to pay bills on the ad-. ditions to the Woodrow Wilson High School and the Jefferson St. School. On motion, the request was referred to the Finance Commit%ce. A communication was read from ~ "taxpayer~ in West P~rk View with regard to 'needed im- provements in said Bection of the City, and on motion of Mr. Brooks same wms referred to the City Man~ger for investigmtion mhd report. On motion of Mr. Brook~, the City Attorney wms instructed to repor~ ~o the Council at its next regular, meeting the status of the suit of the City a~ainst the Cheaa~eake & P~om~c Telephone Co. Mr. Esleeck moved that Mr. H. L. ~texander be offered $10,O00.00 by the ?ty for his land om Court street, hetwee~ Wylthe street and the S. A.
