087 <br /> <br />Sec. 9-34. Certificates of OWnership have not been used & <br />9-38 in recent memory. The request is to indicate in the Code <br />that the receipt issued for graves will suffice for proof of <br />purchase. <br /> <br />Sec. 9-40. Current records do not reflect birthplace, condition, <br />marital status or cause of death. This information is no longer <br />relevant, and it should be deleted from the Code. <br /> <br />Sec. 9-43. The Code should reflect that the contractor, not the <br />City, is responsible for interments. <br /> <br /> Also, the following sections are recommended for deletion <br />from the Code as indicated. <br /> <br />Sec. 9-3. Trespassing at night, <br />visits to cemeteries. <br /> <br />Sec. 9-30. Owner perpetual Care. <br />by the City. <br /> <br />Delete allowance for nighttime <br /> <br />All perpetual care is provided <br /> <br />Sec. 9-32. Certificates of purchase are no longer issued. <br />Receipts and/or canceled checks are proof of purchase. <br /> <br />Sec. 9-33. Certificates no longer issued. <br /> <br />Sec. 9-42. Supervision and performance of work is now <br />accomplished through contractor. <br /> <br />Sec. 9-102. Designation of single grave portions of cemeteries <br />is no longer a responsibility of the City Manager. <br /> <br /> The above listed changes will bring the City Code in line <br />with existing policy and practice. I concur with the <br />recommendations and recommend approval." <br /> <br /> Motion by Mr. Hawks, and seconded by Mr. Pitts, to adopt <br />the following ordinance, and was adopted by the following vote: <br /> <br /> "AN ORDINANCE TO AMEND CHAPTER 9 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 9-26(A), 9-34, <br />9-38, 9-40 AND 9-43, AND BY REPEALING SECTIONS 9-3, 9-30, 9-32, <br />9-33, 9-42 AND 9-102 THEREOF, PERTAINING TO CEMETERIES." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />95-179 - Letter from the City Manager recommending adoption of <br />an ordinance to close streets, alleys and lanes lying within the <br />new I. C. Norcom High School site, and a resolution authorizing <br />the City Manager to release utility easements in the closed <br />portions of certain streets within the new I. C. Norcom High <br />School site. <br /> <br /> a. Ordinance to close streets, alleys and lanes within the <br />site of the new I. C. Norcom High School. <br /> <br /> b. Resolution authorizing the City Manager to release <br />utility easements in the closed portions of certain streets <br />within the new I. C. Norcom High School site. <br /> <br /> "The Portsmouth Redevelopment and Housing Authority (PRHA) <br />the City and the School Board have filed applications requesting <br />the closure of those streets, alleys and lanes that lie within <br />the site to be created for the construction of the new I.C. <br />Norcom High School. The viewers which you previously appointed <br />have recommended approval of the applications, and the Plannlng <br />Commission concurs with their recommendations. The property <br />adjacent to all the streets, alleys and lanes are now owned by <br />PRHA, the City and the School Board. <br /> <br /> <br />
