July 9, 2002 <br /> <br /> Motion by Mr. Moody, and seconded by Mr. Pitts, to concur with the <br />recommendation of the Planning Commission that Z-02-07 be approved on first reading, <br />and was adopted by unanimous vote. <br /> <br />(f) S-02-01 <br /> <br />DOWNTOWN NEIGHBORHOOD - Ordinance granting the request <br />of the City of Portsmouth for the closure of a portion of Wythe <br />Street and Harbor Center Way. The purpose of the closure is to <br />remove the encroachment of the Harbor Center Amphitheater into <br />the right-of-way. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Moody, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE CLOSING AND VACATING A PORTION OF WYTHE STREET AND <br />HARBOR CENTER WAY LOCATED AT THEIR NORTHEASTERN INTERSECTION." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />02 - 189 - Adoption of various ordinances to amend Chapters 11, 16, 17, 19, 22, 24, 25, <br />32, 37 and 39 of the Portsmouth City Code in order to increase certain fees, fines and <br />cost of permits currently assessed by the City. <br /> <br />Based on a survey of the region, recommendations have been made to increase <br />a number of fees and fines to amounts more comparable to other Hampton <br />Roads cities. Also, certain fees were established during the 2002 General <br />Assembly session that may be adopted by local ordinance. <br /> <br />Recommendation: <br /> <br />· Adoption of various ordinances to amend Chapters 11, 16, 17, 19, 22, 24, 25, 32, 37 <br />and 39 of the Portsmouth City Code in order to increase certain fees, fines and cost of <br />permits currently assessed by the City. <br /> <br />Purpose and Need: <br /> <br />· All City departments were asked to review Portsmouth's fee and fine structure <br />relative to the cities of Chesapeake, Hampton, Newport News, Norfolk, Suffolk and <br />Virginia Beach. <br /> <br />· Based upon this review, recommendations have been made to increase a number of <br />fees and fines to comparable amounts charged by the other Hampton Roads cities. <br /> <br />· In addition, during the 2002 General Assembly session, certain fees were <br />established by State Code that may be adopted by local ordinance. <br /> <br />· A summary of Fee Comparison and Recommendations accompanies this <br />transmittal. <br /> <br />· The proposed changes are listed by City Code Chapter: <br /> <br />a) Chapter 11 - Land disturbance and Inspection Fees: This is a new permit and a new <br />fee and is related to the Erosion and Sedimentation Control Law based upon submittal <br />and inspections performed subsequent to plan approval. Fees shall be included in the <br />approval letter for all plan submittals. There will be no fee for single family residential <br />except for those lots within the Chesapeake Bay Preservation Act area with disturbance <br />equal to or greater than 2,500 square feet - the fee will be $50. For all other <br />construction, there will be a $50 minimum fee for all disturbances up to once acre. <br />Each additional acre or part of acre will be charged an additional $35. It is estimated <br />that the fees generated from this fee will be approximately $12,000 annually. <br /> <br /> <br />
