May 28, 2002 <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That LPD Associates, Inc., is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for a hotel expansion at <br />3222 Western Branch Boulevard, and being more particularly described as: <br /> <br />UP-02-05 <br /> <br /> Beginning at a point that is 120' east of the intersection <br />of the east right-of-way line of Kenny Lane and the <br />Portsmouth/ Chesapeake city line, thence east 200'+/- to a <br />point, thence north 216'+/- to a point, thence west 201.2'+/- to <br />a point, thence south 216'+/- to the point of beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which shall <br />be observed by the applicants and any successor in interest: <br /> <br /> (a) The building shall meet all applicable building codes and standards, <br />including the Americans with Disabilities Act (ADA) regulations, and shall obtain and <br />maintain all necessary licenses and permits. <br /> <br /> (b) The building shall be inspected annually by the City's Fire Prevention <br />Bureau, Public Health Department and Building Official. <br /> <br /> (c) The portion of the property that abuts residentially zoned property shall be <br />screened with a Group 1 landscaping buffer and a 6-foot wooden fence. <br /> <br /> (d) The proposed hotel addition will be two-stories in height and shall house <br />no more than 20 suites, an indoor swimming pool and a fitness center. <br /> <br /> (e) The hotel addition shall be no closer than 30 feet to any property line <br />abutting residential zoning. <br /> <br /> (f) Site signs shall be oriented towards Western Branch Boulevard, rather <br />than towards a residential street. <br /> <br /> (g) All services associated with the development must be located so as not to <br />require access from an interior residential street and must be screened so as not to be <br />visible from any abutting residential property. <br /> <br /> (h) The parking lot and the small terrace serving the indoor pool shall be <br />located on the eastern side of the building. <br /> <br /> (i) Drawings and calculations shall be submitted to the Engineering <br />Department for approval of the stormwater retention pond. Maintenance of the pond <br />shall be the responsibility of the property owner. <br /> <br /> (j) Vehicular access from an interior residential street is prohibited. All <br />ingress and egress shall be from Western Branch. <br /> <br />(k) The property owner shall maintain all landscaping. <br /> <br />Sleep Inn. <br /> <br />The materials and design of the hotel addition shall match the adjoining <br /> <br /> (m) Illumination shall be designed, installed and maintained in a manner that <br />avoids glare or reflection that in any way interferes with the adjoining residential <br />properties on the northern and western property lines. <br /> <br /> (n) The hotel addition shall be constructed in accordance with the submitted <br />site plan, labeled "Exhibit A." <br /> <br /> <br />
