1'00 April 25, 1995 - PUBLIC HEARINGS 95-207 Public hearing to consider proposed changes to the real estate tax rate, Public Utility rate for water, cigarette tax rate and the rate on refuse and garbage collection and disposal. There were no speakers. 95-208 Public hearing on a use permit application: (a) UP-95-08 HATTONSVILLE NEIGHBORHOOD Use permit application of Hampton Roads Regional Jail Authority for a regional jail facility on properties bounded by Adamson Street, Elmhurst Lane, Ballard Avenue and Duncan Street. Roy W. Cherry, Regional Jail Director, provided information on the proposed Regional Jail. Daniel Williamson, 421 Mayflower Road, spoke in opposition to the proposed jail. Motion by Mr. Hawks, and seconded by Mr. Pitts, to concur with the recommendation of the Planning Commission that UP-95-08 be approved on first reading, and was adopted by a vote of 6-1 (Clemons). - UNFINISHED BUSINESS CONSENT AGENDA 95-166 - Use permits, rezoning, comprehensive plan amendment, and a code amendment: Motion by Mr. Robinett, and seconded by Mr. adopt the following resolutions and ordinances, by the following vote: Martin, to and was adopted 95-166 (b): "A RESOLUTION GRANTING A USE PERMIT TO GLADYS B. HILL FOR THE OPERATION OF A CHILD DAY CARE CENTER TO BE LOCATED AT 2605 ELLIOTT AVENUE. WHEREAS~ by resolution dated July 28, 1992, Council granted a use permit to Gladys B. Hill, child care center for fifty (50) children;and the City to operated a WHEREAS, the applicant now desires to expand the capacity of her facility and has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting-of a use permit to operate a child care facility to be located at 2605 Elliott Avenue, Portsmouth, Virginia, as hereinafter-described; WHEREAS, the applicant and the Planning Director have done all things required to be dOne in connection with said application~ and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia~ 1. That the use for which the permit hereinafter- described is sought~ (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use;
