112 <br /> <br />April 25, 1995 <br /> <br /> The original motion to adopt the following resolution, was <br />adopted and by the following vote: <br /> <br /> "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />PORTSMOUTH, VIRGINIA, ELECTING TO HAVE FULL-TIME SWORN <br />FIREFIGHTERS AND POLICE OFFICERS HIRED ON OR AFTER JULY 1, <br />1995, PARTICIPATE IN AND BECOME-ELIGIBLE FOR ALL BENEFITS <br />EQUIVALENT TO THOSE PROVIDED FOR STATE POLICE OFFICERS, AS SET <br />FORTH IN SECTION 51.1-138 OF THE CODE OF VIRGINIA, AND TO <br />AUTHORIZE AND DIRECT THE CITY MANAGER TO EXECUTE THE NECESSARY <br />DOCUMENTS TO IMPLEMENT THIS BENEFIT. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, <br />desires to provide retirement and other benefits to <br />firefighters and police officers; and <br /> <br />Virginia, <br />~worn <br /> <br /> WHEREAS, the City Council desires to provide such <br />retirement benefits as are provided to state police officers of <br />the Department of State Police under Section 51.1-138 of the <br />Code of Virginia; and <br /> <br /> WHEREAS, the City Council desires to implement this <br />resolution effective with all firefighters and police officers <br />hired on or after July 1, 1995. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Council of the <br />City of Portsmouth, Virginia, a political subdivision of the <br />Commonwealthof Virginia, currently participating in the <br />Virginia Retirement System under Title 51.1 of the Code of <br />Virginia does hereby elect to have such employees of the City <br />who shall become employed on or after July 1, 1995, in <br />positions as full time salarled firefighters and police <br />officers which positions are not restricted as to temporary or <br />provisional appointment,, become eligible to be provided <br />benefits in the Virginia Retirement System. <br /> <br /> BE IT FURTHER RESOLVED that the City elects to provide <br />benefits in the Virginia Retirement System to these same <br />employees that are equivalent to the benefits provided for <br />state police officers of the Department of State Police, as set <br />out in Section 51.1-138 of the Code of Virginia, and as may be <br />amended from time to time, in lieu of the benefits that would <br />otherwise have been provided under the Portsmouth Fire and <br />Police Retirement System. The City agrees to pay the ~ <br />employer's cost and the employee's share of such cost for <br />providing said benefits to these employees. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and <br />hereby is, authorized and directed to execute any required <br />contract or other documents in order that the benefits herein <br />authorized may be enacted in the lawful conclusion of this <br />matter. The Director of Finance and the City Treasurer, are <br />hereby authorized and directed to pay over to the Treasurer of <br />the Commonwealth of Virginia from time to time, such sums as <br />are to be paid by the City for this purpose." <br /> <br />Ayes: Griffin, Hawks, Pitts, Robinett, Webb <br />Nays: Clemons, Martin <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Robinett, to <br />adopt the following ordinance, and was adopted by the following <br />vote: <br /> <br /> "A/~ ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 30-201 <br />THEREOF, PERTAINING TO THE PORTSMOUTH FIRE AND POLICE <br />RETIREMENT SYSTEM." <br /> <br /> <br />
