>ril2 1995 <br /> <br /> Motion by Mr. Clemons~ and seconded by Mr, Martin, to adopt <br />the following resolution, and was adopted by the following vote= <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE SUCH <br />DEEDS AS MAY BE NECESSARY TO ACQUIRE A PORTION OF A 40 FOOT <br />STRIP ON THE NORTH SIDE OF CHURCHLAND BOULEVARD AND THEN TO <br />CONVEY SAiD PROPERTY TO THE COMMONWEALTH OF VIRGINIA, FOR THE <br />WIDENING OF CHURCHLAND BOULEVARD. <br /> <br /> WHEREAS, by deed dated August 28, 1987, and dUly recorded <br />in the Clerk's Office of the Circuit Court of the City of <br />Portsmouth in Deed Book 994, at page 258, the City of Portsmouth <br />did convey to Churchland Shopping Center Associates, a Virginia <br />General Partnership, a forty (40) foot strip of land dedicated <br />for future road widening on the plat of Pride Homes for the sum <br />of twenty-five thousand dollars ($25,000.00); and <br /> <br /> WHEREAS, said deed provided that in the event all, or a <br />portion of said strip was necessary for street improvements to <br />Churchland Boulevard as a part of Department of Transportation <br />Project U00-124-105, PE101, Churchland Shopping Center <br />Associates would reconvey said property, or a portion thereof, <br />to the City for the sum of twenty-five thousand dollars <br />($25,000), or a portion or part thereof should less than the <br />whole of the entire parcel be necessary; and <br /> <br /> WHEREAS, the Virginia Department of Transportation has <br />embarked upon a program of acquisition preparatory to the <br />widening of Churchland Boulevard,_and has called upon the City <br />to reacquire a portion of the strip hereinabove mentioned, and <br />convey the same to the Co~L~LLonwealth of Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he hereby <br />is authorized to acquire so much of that certain forty (40) foot <br />strip of land conveyed to Churchland Shopping Center Associates <br />by deed dated August 28, 1987, and duly recorded in the Clerk's <br />Office of the Circuit Court of the City of Portsmouth in Deed <br />Book 994, at page 258, and to then convey to the Commonwealth of <br />Virginia the land reacquired by such deed." <br /> <br />Ayes: Clemons, ~r~ffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />95-212 Letter from !the City Manager recommending adoption of <br />the following ordinances and a resolution which are being <br />reco~anended in conjunction with the proposed annual operating <br />budget for 1995/96 fiscal year. <br /> <br />(a) An ordinance which establishes the tax rate on real estate <br />at $1.36, and re-enacting the current tax rates on tangible <br />personal property, privately owned pleasure boats, privately <br />owned c~unping trailers and motor homes, and machinery and tools. <br /> <br />(b) An ordinance amending the tax rate charged on cigarettes <br />from the current 12.5 mills per cigarette (25¢ per pack of 20) <br />to 15 mills per cigarette (30¢ per pack of 20). <br /> <br />(c) An ordinance establishing the rate of water at $2.00 per <br />1,000 gallons. <br /> <br />(d) An ordinance amending and modifying the City Code in <br />compliance with the federally mandated Clean Water Act, by <br />establishing and expanding definitions, fees, and methods of <br />administration for the Stormwater Management program. <br /> <br /> <br />
