July 11~ 1922 NEW BUSINESS The following Communication was read from the City Attorney: "Portsmouth, Va., "Honorable City Council, July 11; 1922. Portsmouth, Va. Gentlemen:-- In reference to the suit of the City against the Chesapeake and Potomac Telephone Company, the local court has decided the ease against the city on a demurrer, sustaining three grounds submitted by the defendant. Two of the grounds go to the merits of the case and to l~rther prosecute the ssme it would have to be taken to the 8upas Court of Appeals. A petition was read from the School Board requesting an appropriation from Eigl~_th Ward funds of an additional amount Of $1,500. for the completion and equipment of the colored school at Pinners Point. On motion of Mr, B~ooks, the privilege of the floor was granted to Mr. C. N. Markham, member of the School Board, who spoke as to the request; : On motion, the request was referred to Finance Committee. A bill of S. T. Mon~ague, Jr., to amount of $157.50, for services rendered in destroying 63 tagless dogs $ $2.50 each, was referred to the Finance Committee ......... A communication was remd from Mrs. E. J. Clinton asking th be refunded $~.50, pai i as taxes on a oar not owned by her, and same was referred to the Finance Committee. A r~quest was read from the Oity Collector that Isaac Fass be refunded $6.60, paid in error for auto~6Bile license No. 1913; also for the Commissioner of Revenue to be auth~rized 'to can- cel the license. On motion, the request was referred to Finance Committee. A petition was read from R. L. McMurran, J. D~vis Reed, Fran~ Lindsay and John C. Niemeye:, for permission to erect poles for a high power electric wire line -from Beep Creek to the North Carolina line on the road now known as the Dismal Swamp Road, and same was referred to the City Manager. A petition was received from W. B. Sykes to be paid for ~? days pay at the :~ate of $~.~5 per~ day, amounting to $~30.'6~, and s~lso ~hospital bill of $167.05, ~otal, $5~?.~O,~ on account of acci~ent/..mused by fire engine striking automobile in which he was on ~ot~on, the petition w~s referred to the City Manager, Mr. on the traction matter, and moved ~hat it be acted on at the s~ por~ from the Committee of the Whole will be considered. The motion White submitted the following amendment to the report of the Committee of "1.
