<br />ive, it will not grant any.franchise, permit or license to any other firm, person or corporation
<br />to Spera~e s. ny system of or separate vehicles for urban transportation in competition with
<br />the Virginia Railway & Power Co., nearer than two blocks from the portion of any street on
<br />whl~ the Virginia Railway & Power Co. operates or may operate its s~reet cars or trollibusses
<br />in the ~City of Portsmouth unless and until the Virginia Railway & Power Co. has previously
<br />given its consent in wri~ng."

<br /> Mr. Smith moved to amend 11, paragraph (k) as follows: "Double tracking on Port Norfolk
<br /> far as Chautauqua ave., and loop at Pinners Point with the necessary amount of the
<br /> equipment, thoroughly ~enovated, to give a ? 1/2 minute schedule to Port Norfolk and
<br /> Point," .instead o~ ? 1/2 minute schedule to Port Norfolk and a 10 minute schedule to
<br /> Point.~

<br /> "WHEREAS, An efficient and adequate system of
<br />essential to the progress, expansion and prosperity

<br /> "WHEREAS, Such a system mdst ,of its nature be a monop~so.regulated as ~o protect the
<br /> interests of the City and its citizens, while at the same time lmsuring a just and inviting
<br /> return on the capital invested in the enterprise or needed for its future explansion.

<br /> "BE IT RESOLVED, Nothin~ in this resolution shall be considered as finally binding upon
<br />the City or as ~elinquishing ann rights in its streets or under its charter until the ordi-
<br />nances desdribed by title and summarized herein shall ha~e been enacted into law and until
<br />all requirements and provisions of municipal ordinances and s~ate laws have been complied
<br />with and a format contract entered into with the0ity by the Virginia Railway & Power Co.,
<br />accepting the terms and conditions of said ordinances.

<br /> "BE IT FURTHER RESOLVED, by the Council of the City of Portsmouth, in special session
<br />assembled that it formally goes on record as expressing its willingness and intention to enact
<br />and hereby authorizes and directs the City Manager and City Attorney to draft ordinances
<br />of which the titles and essential features shall be as follows:

<br /> 1. AN ORDINANCE RE-ROUTING, REGULATING AND RESTRICTING ~HE 'OPERATION OF VEHICLES PRO--
<br />PEELED BY GASOLINE OR OTHER INTERNAL COMBUSTION E~GINES OR E~AWN BY ANIMALS ~ND USED IN THE
<br />TRANSPORTATION OF PASSENGERS ON THE STREETS OF THE O~TY OF PORTSMOUTH OVER FIXED ROUTES AT
<br />A FIXED RATE OF FARE.
<br />
<br /> This ordinance will provide:
<br />
<br /> (a) That the City of Pormsmouth agrees that ~n and after the ordinance becomes effective,

<br /> (b) Within i~O days after the improved service on an2 line provided for has been put
<br />into operation, it will re-route, restrict and regulate all'existing systems of or separate
<br />veb/~es for urban transportation operating on this line other than those belonging to the
<br />Virginia Railway iand Power Co., so tha't they will not run on s~reets used for urban trans-
<br />~o~,~tion of Passengers by the Virginia P~ailway & Power Co. or nearer than two blocks of
<br /> such streets. '

<br /> (c) This provision shall not apply in the case of streets adjacent to terminii, to
<br />intersections or~o such other limited portions of any street, the use of which by other mean~
<br />of urban traasportation than that belonging to the V~rginia Railway & Power Co., is-manifes't~
<br />ly demanded for ~he comfort and convenience of passengers using such transportation,nor Shall
<br />it apply under t~e exceptions described Xn Sec. of ~hie ~ssolutien.

<br />lines(d) 'Nor-shall this apply to such jitney lines as are op~trated to suburban points. S~Ch
<br /> shall, however, be prohibited from doing any local business in the City. Nor shall such
<br />restrictions apply to temporary jitney line operated on High, Cooke and Villa streets to West
<br />Park View, until ithe trolley bus line to West Park View has been installed and put into
<br />tion by the Virginia Railway and Power Co. '
