"In order to get satisfactory drainage at the corner of Ninth Ave. and Perry St., <br />it will be necessary to construct curbing on 'Perry St. This is essential on the north side <br />only, but I believe it will cause so much discontent o~ the south side that I r e~ommend curb- <br />ing and guttering for both sides. The cost will be $1,200. No additional appropriation will <br />be neede~as ~t will be paid for from the bond issue and will simply menu an extension of <br />the authority granted by the City Council at its meeting on June 27th, 1922." <br /> On motion of Mr. White, the recommendation of' the Manager was concurred in, and by <br />the followiBg vote: <br /> Ayes-- ~rooks, Esleeck, Hntchins, Oast, Smith, Stewart, White, <br /> <br /> 12th. Recommendation that the following r e~olution be adopted: <br /> <br /> "BE IT RESOLVED, by the Council of the City of Portsmouth, that it will guarantee <br /> the payment of all interest in excess of that guaranteed by the County of Nor- <br /> folk, on the cos~ of the construction of that portion of ~tate Highway No. 12, <br /> extending from Deep Creek, Va., to the North Carolina line, it being under- <br /> stood that the funds for this construction will be lent to the Etate Highway <br /> Commission by the ba~uks of the City of Portsmouth and that the limit of the <br /> amount so advanced for a gravel or macadam road shall be $130,O00 or for a <br /> concrete road $300,000.00." <br /> <br /> On motion of Mr. White, the recommendation of the Manager was adopted, <br />following vote: <br /> Ayes-- Esleeck, Cast, Et~wart, White, <br /> Nmys-- Brooks, Hutchins, Smith, <br /> <br />and by the <br /> <br /> 13th. "Enclosing copies of ~op~sed agreement between the City of Portsmouth, party of <br />the first part and R. R. Robertso~, Kappa Corporation, a~d Watervtew Corporation, parties <br />of the second pmrt, for the construction of water mains in Waterview. This contract provides <br />briefly ~hat the p~rties concerned shall pay for the construction of all mains which are to <br />be laid by the Water Dep~rtment and that when the gross inco$? amounts to fifteen per cen~ <br />of the total cost of all material mhd labor for installing mamns of six inch diameter or <br />over, the City cf Portsmouth will pay to the pa~ties of the second part oolleo~Zvsly, the <br />cost of said mains, e~l~sive of interest. The cost of mains less thmn six inches in dia- <br />meter will not be pai~ by the City of Portsmouth. <br /> <br /> It is recommended that ! be authorized to sign this contract, Of course, a simila~ <br />agreement will be made with other responsible corporations." <br /> <br /> On motion of Mir. Brooks, the proper O~ficers of the City were authorized to execute <br />the said contract. <br /> The follo~ingys the contract: <br /> ~"~H!~ AGREEMENT, Made this d~y of 1~22, <br />between the City of Portsmouth, a municipal corporation of the State of Virginia, party of <br />the firsz pa~t, and R. R. Robe~tson, Kappa Corporation, a~ud Waterview Corporation, parties <br />of the second par~, <br /> <br /> WHEREAS, The parties of the second part are the owners of certain sep~ate parcels of <br />land in the County of Norfolk, Virginia, which have been subdivided into builcling tots and <br />amc shown on the plat of Wate~view, recorded in the Clerk's Office of Norfolk County in <br />M~p Book page , and they desire that the City of Portsmouth shall furnish water to <br />the said territory, and have agreed to pay the expense of layln£ certain water pipes, ~he <br />cost of which is to be refunded them by ~kid~City when the gross receipts from the sale of <br />water from such pipes in said territory sh~ll be sufficient to make such refund. <br /> <br /> NOW, T~REFORE, THTS AGREemeNT W~TNESEETH: That in consideration of the premises and <br />the mutual covenants and agreements on the part of the parties thereto, the s~id parties of <br />the second part covenant and agree as follows: <br /> <br /> r ' · · ~ · ~ <br /> (1) o pay all costs of constructing a~d laying a six-znch water rom the present <br />wa~er pipes~of s~id C~ty ~t the intersection of Carolina Avenue and Kin ts at Westhaven <br />northward a~ong ~aroi~na Avenue and theno, e across private property t9 ~'Btreet to a ' <br />poxnt.at~o~ pear the Western Branch Boulevar.d as shown on a diagram ttached and m~de <br />a par~ om ~nms agreement; the ~mid work to be done by the Water Depaft~of the City of <br />Portsmouth, in accordance with plans and specifications of that Department. <br /> (2) The said parties of the second part shall obtain and convey to the City of Ports- <br />mouth without charge all necessary rights of way over and across all property not owned by <br />them for the laying of said water ~ains, ~n~ will gra~t and do hereby grant and convey unto <br />the said City of Portsmouth an excmusive anm perpetual easemen~ and right of way in and ~long <br />Orange Street, Riverside Drive, W~stern Branch. Boulevard, and all other streets and alleys <br />upon their respec~ive land mm shown upon the said plat for the purpose of laying, maintaining, <br />and repairing water pipes and mains and the necessary appurtenances thereto for the supply <br />of water. <br /> <br /> (3) The said wamermalns and pipes when so laid ~ud constructed shall be the sole pro- <br />perty of and under the exclusive control of the City of Portsmouth. <br /> <br /> (4) If any additional mains are desired by the parties of the second part, the same may <br />be laid provided the size, material and location of such m~ins are approved by the party of <br />the first p~rt; all costs of constructing mhd laying such mains shall be paid by the parties <br />of the second part, the work to be done by the ~ater Depam~men~ of the City of Portsmouth. <br /> <br /> All such mmin~ shall be the property of and under the exclusive control of the City of <br />Portsmouth as soon as completed. <br /> <br /> <br />
