Smith, <br /> <br /> The minutes of the regular meeting November 28th and <br />read and were approved. <br /> <br />special meeting December 4th were <br /> <br />Finance-- <br /> <br />REPORTS OF COM~ITTEES_ <br /> <br />NO repot ~. <br /> <br /> The following matters were received from the City Manager: <br /> let. The City M~nager verbally <br />recommended that he be allowed to rent the third floor of the Welton building for the Drafting <br />Section of the Department of Public Works, at $~0.00 per month, without~dditional appropriation. <br /> Mr. Stewart moved that t~e City Manager be authorized to secure an Office for same, <br />mt a cost not to exceed $40. per month, without additional appropriation. <br /> The motion was adop~ted, and by the following vote: <br /> <br />Ayes--Hutchins, Cast, Smash, StUart, White, 5. <br /> <br />~NFINI SHED BUSI!{ESS <br /> <br /> The reports of th~s City Treasurer, City Auditor, and City Collector for the month of <br />Eovember, 1922, were pre~ente¢~ and were referred to the Fin~ance Committee. <br /> <br />The following oommmuioation was read from the City Attorney: <br /> <br />· Hon. City CoUncil, <br /> Portsmouth, Va. <br /> <br />"December <br /> <br />12th,- 1922. <br /> <br /> "Gentlemen: <br /> Qn December l, 1922, a case was called in the Circuit Cottrt of the City in- <br />stituted by Ers. Agnes W. Stearns against the City of Portsmouth. Mrs, Stearns was injured <br />on the night of June l~th, i~22, by stubling over a brokem place in the concze2e pavemen~ <br />on the west side of Broad street. The broken part of the pavement extended about one,third <br />of the distance of the sidewalk and had an elevation of about three inches. Mrs. Stearns <br />~pr~ned her ankle and claims she can not walk without sometHin~ braoin~ her f~o+ ~ ..... ~ <br /> or $5,000.00. Ifoffe=ed to compromise the case by paying he~ $2~.O0 ~nd the~o~rt~s~~ <br />Her attorney agreed to compromise if I should request the council to pay her $~O0. and the <br />Court costs. Barclay, City Attorney." <br /> On motion, the recommendation was referred to the Financ~ Committee. <br /> <br /> As to the election of a successor to W. F. Robertson, resigned from the School Board, <br />First School District, which was deferred from last meeting until this meeting, l~r. White <br />moved that Council now go into an election for this purpose. The motion was adopted. <br /> Mr. ~hite then nominated Mr. ~. ~lter Mathews for the position, and there being no <br />other nominations, he was elected, a~d by the following vote: <br /> <br /> Ayes--H~tchins, Cast, Smith, Stewart, White, 5- <br /> <br /> On motion of Mr. Sast, the following ordinance, which had been placed on its first read- <br />ing November 28th, was continued on the table until the next regular seeting: <br /> <br /> An Ordinance to Authorize the Issue of Two Hundred Thousand Dollars of Bonds ~o be K~own <br />as "Market Bonds" Pursuant to Section 127, Clause B, of the Constitution of Virginim, Section <br />30~1 of the Code of Virginia 191~, entitled, "An Act to Authorize th~Oouncils of the Several <br />Cities or Towns of the Sta~e to Issue Bonds for a Supply of Water or other Specific Undertaking <br />from Which the City or Tg~n mmy Derive a Revenue, Pursuant to Section One Twenty-Seven B of <br />the Constitution of Vir~n~m~." <br /> <br /> The following ordinance, which wam~laced on its first re~dlng November 28th, was taken <br />up and read: <br /> AN ORDINANCE FIXING THE COMPENSATION OF TH~ CITY TREASD~RER. <br /> <br /> Mr. White moved that the ordinance ~e amended so as to make the compensation Three Thousand, <br />and by adding the following clause: "but the term City funds,~mentioned above shall not be <br />construed to include ~unds handled for the School Board of the City of Por%smouth." <br /> The amendments were ~dopted by the following vote: <br /> <br /> Ayes-- Hutchins, 0asr, ~ith, Stewart, White, <br /> <br /> .Then on motion of ~r.
