That, in order to increase the City's undesignated General Fund Balance <br />which supports all City and School functions, Council will retain 25% of any such <br />unspent operating fund balance, thus returning a net of 75% of such funds to the School <br />Division; and <br /> <br /> 3. That such funds as are appropriated to the School Board under the <br />provisions of this Resolution shall be in addition to any other funds appropriated for <br />School Board capital projects as part of the annual Capital Improvements Program <br />appropriation process; and <br /> <br /> 4. That this policy shall apply beginning with fund balances for fiscal year 2001 <br />and shall continue in effect until modified by Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />01 - 186 - Adoption of a resolution authorizing the City Manager to execute an <br />agreement with the Virginia Department of Transportation (VDOT) to convey to the <br />Commonwealth of Virginia an easement for drainage across the I. C. Norcom High <br />School property adjacent to Jamestown Avenue. <br /> <br />The easement is a part of the Turnpike Road improvements and will allow VDOT <br />to take storm drainage from Turnpike Road to avoid the destruction of utilities in <br />Jamestown Avenue. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution authorizing the City Manager to execute an agreement with <br />the Virginia Department of Transportation (VDOT) to convey to the Commonwealth an <br />easement for drainage across the I.C. Norcom High School property adjacent to <br />Jamestown Avenue. <br /> <br />Purpose and Need: <br /> <br />· This easement is a part of the Turnpike Road improvements and will allow VDOT to <br />take storm drainage from Turnpike Road in two large box culverts emptying into Scotts <br />Creek to avoid the destruction of utilities in Jamestown Avenue. <br /> <br />Financial Impact: <br /> <br />· The project is being carried out by VDOT for the purpose of widening and improving <br />Turnpike Road and will be turned back to the City when fully complete. <br /> <br />· VDOT expects the easement to be provided without compensation to the City. <br /> <br />1. Ed Giles, 1729 Bradford Terrace, spoke in opposition to the easement for drainage. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Griffin, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO GRANT A PERMANENT <br />DRAINAGE EASEMENT AND A TEMPORARY CONSTRUCTION EASEMENT OVER, <br />UNDER AND ACROSS THE SITE OF THE I. C. NORCOM HIGH SCHOOL. <br /> <br /> WHEREAS, the site of the I. C. Norcom High School is titled in the name of the <br />City of Portsmouth, Virginia; and <br /> <br /> WHEREAS, the site is used for an active school, and is controlled by the School <br />Board of the City of Portsmouth, Virginia; and <br /> <br /> WHEREAS, the Commonwealth of Virginia acting through the Virginia <br />Department of Transportation "VDOT" desires to construct a double box culvert for <br />storm drainage in connection with its plans to improve Turnpike Road; and <br /> <br /> WHEREAS, the School Board of the City of Portsmouth, Virginia has agreed by a <br />resolution that the City Manager grant easements for such construction to the <br />Commonwealth of Virginia. <br /> <br /> <br />
