<br />OrdinanCe in 0onneotion with Buildings of a Public Character, Such as Theatres, Hotels,

<br />On motion of Er. ~hite, the ordinance was placed on its first reading.
<br />
<br /> 6th. "With reference to communication from certain r-esidents and property owners in the
<br />vicinity of Oou~t and~ythe Sts. protesting against the erection cf a gas station on the north-
<br />east corne~b~D. P. G. Blanford, I beg to state that in my opinion the~e is no legal way in
<br />which the City can stop the erection of this structure. The applica~proposes to front the
<br />building on Cou~t St. and this block of Court St. seems to me clearly a business block.
<br />
<br /> I therefore recommend that the Clerk inform the petitioners that the Council can
<br />do nothing further in this matter. It might be noted, also, that Mr. Blanford voluntarily
<br />withdrew his application for the construction of the building on the opposite corner, due to
<br />protests from citizens.~

<br />On motion of Nr. Brooks, the recommendation of the Manager was concurred in.

<br /> 7th. "With reference to instructions of the Council given at its meeting cf Sept. 25th
<br />relative t6 relieving jitney drivers of payment of license tax, I beg to state that I have
<br />taken this matter up with the Tr~nspor~atlon S~ervisor~ and he informs me that it was the
<br />intention of the ordinance as dmawn that the 5~ of gross receipts should be in lieu of other
<br />license tax excepting the property tax.

<br />I therefore can only repeat my previous recommendation."

<br /> Nr. Brooks moved that the recommendation of the ~anager be concurred in. Mr. White
<br />moved to amen~ that same be referred to the Finance Committee. M~. l~hit~'e amendment was
<br />adopted,

<br /> 8th. eOn August l~th, the Council authorized me ~o offer 10% in excess of the assessed
<br />values ~o all property owners on the proposed municipal building~ite and if these offers ~ere
<br />refused to proceed to condemn the property. I have made these offers as authorized and have
<br />received replies declining my offer from F, H. Miller ~nd Goodrich Hatton, Luclile and Calvin
<br />T. Hill, J. L. McGriff~ Richmond Edwards, ~da A~ Edwards, Henry Levy, the Morris S. Cain Est.,
<br />Moss W. Armistead, Nartha A. Brown and Henry Hicks. The following offers have been accepted:
<br />.¥~$P. and Lena 0. Thornton, $7,370.00; John T. Hunt, $1,705.00 and Rachael Colding Webb,
<br />$~,775.00. I have been unable to secure replies from the remaining owners.

<br /> The proceedings in the case of the market site seem to indicate that the resolution
<br />of the Council in that case and in the ease-of the municipal building site would prove defective
<br />if b~eught into court, although we had gotten by with it in several other cases. To avoid the
<br />possibility of this, the Attorney has recommended that a n? resolution be pa~sed naming speci-
<br />fically the owners of the p~eperty and the sum which the C~ty Manag&r is authorized to offer
<br />with a proviso that if these offers are not accepted that he be empowered to insti~ate condemna-
<br />tion proceedings, without again referring the matter to the Council.
<br />
<br /> Z am therefore recommending that the attached resolution be passed. I am further

<br /> WHEREAS, it is necessary for the City to secure the block bounded by Washington, Ocunty~
<br />Green and Sing Sts. in the City of Portsmouth~ for the purpoee cf constructing thereon a muni-
<br />cipal building,

<br /> BE-iT RESOLVED, that the City Manager is authorized to offer the owners the sums placed
<br />opposite their respective names on the attached list, for the property owned by'them and eom-
<br />
<br />prised in the aforementioned site.
