<br /> On motion of Mr. Hall, the ordinance was ptaced~on first reading and the recommendation
<br />with regard 'to special meeting was adopted.
<br /> The Special Em!es Oommi~tee appointed Octobe= 28th to revise the Rules of the Oouncit
<br />presented with recommendation the following:

<br /> On motion of Hr. Jnc. Howard Hall, the Rules were placed ou their first reading.
<br />
<br /> The following co~mm~nications were read from the 0ity Man~ge~
<br /> 1st. "There will be a
<br />meeting at the Chamber of Commerce in Newport News at 3:00 P. M. Thursday, December Ilth,
<br />to ar~se public i~te~est in the Tidewater Trail, which passes through Portsmouth and follows
<br />the Dismal $wamp Road into North Oarolina. I wo~ld suggest that the Council authorize the
<br />Auditor to attend this meeti~g, as the road mmd~ consideration is of vital importance to
<br />Portsmouth."

<br /> On motion of Mr. Oast, the recommendation of the Manager was concurred in.
<br />
<br /> ~nd. "! recommend that action be taken by the Council relative to mY recommendation
<br />covering hucksters. Details of this recommendation, imposing an annual tax cf $600.00 on
<br />ea~hwagon, are now with the ~inance Oom~ittee.~

<br /> On motion, the recommendation ~as referred to the Finance Ocmmittee,

<br /> 3rd, "On the recommendation of 'the Washington Ward Ci~? Leagme,. I h~ve au+~horized the.
<br />City Engineer to put curbs and gutters on Franklin Circle and on Hamilton Ave. north of Thira
<br />St., taking advantage of thesaving in curbing made at other peLuts, where it is at present
<br />impossi~le top ut in curbs on account of grades or fill. This prior authoriz~tionw-as taken
<br />up with the Finance Committee and ~pproved by it. Formal approval or'my action is now
<br />quested by the Council."

<br /> On motion of Mr. Smith, Council approved of the action taken by the

<br /> ~th. "Due to the change in grade in placingthe new pavi~gonMt. Vernon Ave., Third
<br />St. and Hill Ave., the track of the VirginiaRailway & Power Company on Mt. Vernon Ave. be-
<br />tween High and the Boulevard, on Third St. between Jackson Ave. a~dNtll Ave., and on Hill
<br />Ave. between ThLrd St.a~dSouthern, stamds in some places as m~ch as 1~ inches above the
<br />grade of the street. Tb/s not only renders it impossible to use both sides of the stree~
<br />conveniently b~r~ constitutes a grave~menace to both life and property for which the City
<br />liable if it permits such o~structions to remain in its streets.

<br /> X have endeavored to get the Virginia Railway a~ud Power Company'to acquiesce in
<br />the lswerimg of these tracks but without success. I therefore recommend that the City A~-
<br />~or~ey be ~t~cted to ~e~atelyask for ~.~ oo~elli~ ~e co~7 to remedy the
<br />~ge~ous co~tions indicated."

<br />On motion of Mr. Stewart (R.E.B;), the recommendation of ~zhe Manager was con~arred in.

<br /> 5th. ~In accordance with instructions of the Council, ! beg to slate that it will cost
<br />2,O00.00 to put an 1~ ft. macadam roadway o~ Ohestnut St. between Randolphand Lincoln ets.
<br />I beg to call at~ention to the fact, however, that ~he existing right of.way on Chestnut St.
<br />between these two points is only 2y ft~ wide and in my~opi~lon, while this work is very
<br />vSsable, it sh~ld not be done ~util a~ditional width of right of way is secured.

<br />land is condemne~ for the purpose needed. I ~herefore, recommeDd that I_be authorized to
<br />offer the owmer $1,750&00 for the amount of~.la~d~eoessary to extend~the westerly m~rgimof
<br />the street betweem Randolph and Linool~ ets. on the same line as that portion of the street
<br />north of Randolph and if this amount is not a=cepte~,that the Attorney be directed to in-
<br />stitute condemnation proceedings.#
