1 7 3 <br /> June 27, 1995 <br /> <br /> WHEREAS'She'~P~ been informed that approval of <br /> ~gr°up h0uSln~i~r~je~t pursuant to Section 40-116 grants only <br /> )tion from certain requirements for residences as stated <br />~aid section and does not constitute a waiver of any other <br /> embodied in the Subdivision Ordinance, Zoning <br /> Code of the City of Portsmouth, Virginia, or any <br /> applicable local, state or federal law or regulation; and~ <br /> <br />WHEREAS, the applicant is aware that building permits or <br /> required permit will be issued only upon compliance <br />the ordinances, laws or regulations applicable thereto. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br /> Virginia: <br /> <br />That coupled with the terms imposed by paragraph 2 herein, <br />following conditions exist: <br /> <br /> The proposed project is compatible with surrounding land <br />; <br /> <br /> The density of the project does not exceed the maximum <br /> density for the zoning district, and, where <br /> the floor-area ratio of the project does not exceed <br />maximum allowable floor-area ratio for the zoning district; <br /> <br /> The project as a whole conforms to applicable requirements <br />minimum required floor area for dwelling units, minimum <br /> area for dwelling units, maximum allowable area for <br /> of dwelling units, and the maximum allowable area <br /> to residential purposes; <br /> <br />The quantity, quality, utility, size and type of the <br /> s open space and landscaping improvements is sufficient <br /> the decreases in dimensional requirements or other <br /> fromi the zoning district in which the project is <br /> <br />The project's internal traffic circulation system is <br /> to provide for the convenient and safe movement of <br /> and pedestrians, and the ~roject will not cause <br /> streets and roads to exceed their safe capacities; <br /> <br /> The quantity, quality, utility and type of the project's <br /> and common facilities are sufficient to offset the <br /> in dimensionalrequirements and other deviations from <br />zoning district in which the project is located; <br /> <br />The project complies with the standards for approval of a <br />~ermit set forth in Section 40-106 of the Code of the City <br /> Virginia; and <br /> <br /> The projec~.~ provides parking, building access and pathways <br />persons with disabilities in accordance with the <br /> or'the Americans with Disabilities Act. <br /> <br /> That a group housing use permit for the construction of 11: <br />unitsiat the fOrmer William~ Court Site on Victory I <br />(Tax Plate 455, Parcel 1), ~s hereby granted to Beaco~ <br />truction Company, subject to the following terms and <br />£tions: <br /> <br /> The group housing project shall be limited to 112 apartmen~ <br /> (at a density of 11.2 units per acre). The remaining <br />~9 acres shall be developed as single-family housing at a <br />[ty not to exceed 4.2 units per acre. <br /> <br /> <br />
