That the use for which the use permit hereinafter is sought: <br /> <br />(a) <br /> <br /> Will not adversely affect the health and safety of <br />residing or working in the neighborhood of the proposedi <br /> <br />(b) Will not be detrimental to the public use or injurious <br /> property or improvements of the neighborhood; and I <br /> <br />(c) Will be in accordance with the purposes of the Zoning! <br /> of the City Code. <br /> <br /> 2. That John and C~rol Braley are hereby granted a use <br /> pursuant to Section 40-102.2 (B) (1) of the Code of the <br /> of Portsmouth, Virginia, 1988, for the operation of a bed <br />breakfast inn on property located at 420 Middle Street and <br /> more particularly described as: <br /> <br />UP-95-13 <br /> <br />Beginning at the northwestern intersection of London <br /> and Middle Street; thence north along the western <br /> line of Middle Street 120 feet to a point; thence <br />160 feet to a point; thence south 75 feet to a point; <br /> east 15 feet to a point; thence south 45 feet to a point~ <br /> east 145 feet along the northern right-of-way line of <br /> Boulevard to the point of beginning. <br /> <br />That this use permit is approved subject to the <br />conditions: ~. <br /> <br />The bed and breakfast inn shall be operated in accordance <br />the applicant's memorandum dated March 20, 1995 (Exhibit <br /> hereto and made a part hereof. <br /> <br />No more than five (5) bedrooms shall be used for the bed <br />breakfast inn. <br /> <br />The applicant shall keep a guest register of all guest <br /> and shall make the register available for inspection by <br /> of Portsmouth at any time. <br /> <br />Breakfast shall be the only meal served to ~uests. <br /> <br /> No additions or alterations shall be made to the exterior <br /> structure without approval from the Commission of ~ <br />£tectural Review.. ~ <br /> <br /> The applicant shall make adequate parking arrangements with <br />tic Engineering Department to provide. Seven (7) off-st~eet Il <br />~ng spaces within 300 feet from the smte or on site prmor to <br /> of an occupancy permit. <br /> <br />The operators of the bed and breakfast inn shall abide by <br />)ecial regulations of Section 40-52.7 of the Zoning <br /> <br /> <br />
