On motion of Mr. Cast, the emergency clause was struck out. Then on motion of Dr. Dunford, the ordinance was adopted, as amended, vote: Ayes-- Brooks, Dmnford, Nayo, OaSt, stewart, 5. and by the follow- NEW BUSINESS The following communication was read from J. Lewis Thom~s: Honorable Oity Oouncil, Portsmouth, Va. "Portsmouth, Virginia, N~rch 16th, 1927. ~en~lemen:-- About August the loth of last year, an ~oplication for a permit to erect a filling station on Broad Street n~ar Oh~utauqua Avenue was filed by-~the Standard Oil Company. The Oom~any represented to 'the building inspector that it had.~omplied with the ordinance con- cernimg the erection~f the filling station and had-the consent of the adjoining property owner, the m~jority of the buildings already within a 200 foot radius being resideficeg. John High, the owner of the .lot adjoining the site of the proposed service station on the west, did not consent to the erection of such station. With the misleading information which it l~ad- at that time, the oouncil granted the permit for the erection of the station. I am now, on behalf of $ohn High, bringing to your attention the fact that the permit was obtained upon a misrepresentation and had the fact been known, the 'council probably would not have granted the permission for the erection of this s~tion. In be~lf of my c~ient, I am ~espectfmily requesting the 0ouncil to revoke the permit heretofore granted. Very respectfuily yours, J. LEWIS THOMAS." On motion, the privilege of the floor was granted to Mr. Thom~s, who ~poke as to his eom- municatlon. On motion of-Mr. SteWar~, the ¢ommmnicationwas laid on the 'table, Mr. Oast being ex- cused from voting. A request of John L. Bowm~n to ha~e cancelled the back taxes charged against him on his property through a double assessment from 1923 to 1~25, was referred to the Finance Oommittee. Bills were received from the following for the Oity'~ half of premium paid on bond give~ to protect the sinking funds: Bank of Tidewater, $3?5.00, Merchants & Farmers Bank, $3~5.OO, Oittzens Insurance Agency, $Z31.25; State Bank of.Portsmouth,-$250.00; First ~ational Bank, $3?5.00; A~erica/~ National Bank, $3?5.00. A notice was read from the School Board of the exoiration of the terms of office of the following members of the School Board oh April let} R. S. Marshall, First District; W. R.
