<br />a letter from the Southern Dairies, Inc., signed ~y Mr. C. L. Eanbury, Manager at Portsmouth,
<br />asking that we refund to thio company the sum of $102.00 paid in error on two three-ton trucks.
<br />Mr. Hanbury states that thee~ trucks are located in Norfolk and only serves the wholesale trade
<br />of Portsmouth; they are kept in Norfolk amd these licenses wee_re Bought in error. He also has
<br />paid license on two one-ton trucks which are kept and used e~lusively in Portsmouth for retail
<br />trade.

<br /> If th~se.t~$~ta%ements of Mr. Hanbury,s are correct, and ! believe they are, it seems to me
<br />that the $[02~05 paid in error for license on the two three-ton ~rucks should be refunded the
<br />Southern Dairies, Inc.; and .! recommend that this be done, provided the City Attorney's opinion
<br />is given to that effect. ~

<br />tion and Imposing Penalties for Violations Thereof" Adopted by the 0ouncil of the City of Ports~

<br />~entlemen:
<br />
<br /> As directed at your last meeting, I am transmitting herewith am ordinance amending -
<br />the building ordinance requiring the approval of the site for certain classes of buildings.
<br />~ls is amended by omitting the second paragraph which requires consent of the neighboring
<br />owners.
<br />
<br /> I have also draw~ another ordinanoeffor your consideration which I believe will
<br />expedite the approval of sites and at the same time provides for notice to the public who may
<br />object to the building.' Neither o£ these ordinances comply with the state zoning law and are
<br />more or lees doubtful.
<br />
<br /> The State zoning law requires the City to be divided into one or more districts
<br />in which different requirements may be had. A public hearing as to the regulation, restrictions
<br />and boundaries of.the districts must be had after fifteen days notice has been given. A Zoning
<br />Commission to recommend the Boundaries of the districts aud the regulations to be enforced there-
<br />in must be ~pointed by the Court of Hustings... A Board of ~oni~g Appeals composed of five mem-
<br />bers wh~ hold office ftr a term of three years mast also be appointed by ~he Court. To draw
<br />an ordinance complying with the zoning law would require considerable time and thonght and
<br />should contain m~ny other matters sdch as building lines, height of buildings, area, percentage
<br />of lot to be covered, size of yards, etc., which are not covered in 'this ordinance.
