<br /> (And City Attorney) Recommendation of the Manager that $102.OO be refunded the Southern
<br />D~iries, Inc., amount paid in error on two three-ton trucks, the trucks being located i~ Nor-
<br />folk and serving only the wholesale trade of Portsmouth; provided the City A~torney's opinion
<br />is given to that effect.
<br /> It is recommended that a special appropriation of $10Z.O0 be allowed ~o m~ke said
<br />refund% to con~orm with the opinion of the City Attorney.
<br />
<br /> It is fur-ther recommended that a special appropriation of $75.00 be allowed to pay
<br />attorney,s fee for police officers F. M. Snyder, C. j. Whitmore, and O. B. Dunn, in the suit
<br />brought against them by E. L. Bowen, the said suit having been decided in the officers, favor.

<br /> It is further recommended that a special

<br />the appointment of Waiter Bush as sewer attendant at $100.00 per month,

<br /> "I beg to announce
<br />effective June 16th,
<br />
<br /> 2nd. "I received an application today from the Old Dominion Rubber Oompany on First St.
<br />for permission to use one of six storage tanks of 6,000 gal,.capacity each, located on the
<br />Emmerson tract west of the Belt Line and north of the George Washington Highway, near the
<br />three large Texas Oil Compamy tanks. The proposed site is one thousand or more feet from any
<br />dwelling and as stated above adjoins the Texas Oil Oo~l~%ny's property. The Old Dominion Rubber
<br />Oompany at present is get.tl~g~_ their naptha in tank drams of about 50 gal. capacity and storing
<br />it under~ound on their premises on First St. by the use of two ?50 gal. tanks. BY using this
<br />storage tank, for which they are asking permission, the use of the d_rums on their premises will
<br />be eliminated which, in the opinion of the 0hief of the Fire Prevention ~_reau will do away, to
<br />a certain extent with a fire hazard.
<br />
<br /> I have personally inspected the premises today with the Chief of the Fire Depart-
<br />ment and Chief of Fire Prevention Bureau and find that from all ~opearances the tanks are in
<br />first class condition; they are of steel construction, approximately one-half inch thick. The
<br />na~thawill be pumped from the tank car on the track of the Belt Li~e into this 6,000 gal. tank
<br />~nd will be pumped through pipes. The Old Dominion Rubber 0o. will then convey it by truck, as
<br />o~her oil companies deliver g~soline to their plants, to be used as needed. It appears to me,
<br />if an2thing, it would be safer for ~he city and under the ordinances, the 0ouncil onty can grant
<br />permission for the installation of a tank of this capacity. The Company has agreed to keep the
<br />place clean and tidy as required by our rules and regulations and the Chief of the Fire Preven-
<br />tion Bureau will see that this is done.
<br />
<br /> In view of the above, I recommend that permission be g~anted for the use of this
<br />tank. ! might add, however, that when this property was leased, being over the Belt L~ue a
<br />goddmany feet beyond the sign marked 'City Limits,' they thought the property was in the county,
<br />and at this writing they have a car to unload which will go on demurrage tomorrow and for that
<br />reason they are asking that permission be granted tonight if posaible."

<br />of June, 1~27, were presented and were referred to the Finance Oommit~ee.

<br /> With reference to application of the Eittrelt System for the erection of five bill boards
<br />~o be placed in different sections of the Oity, which w~s referred to the City Attorney for
<br />opinion and laid ~n the table until this meeting of Oouncll, the following opinion was read
<br />from the City Attorney:
