March 26, 2002 <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Christina Fulp is hereby granted a use permit pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of an art <br />gallery at 225 High Street, and being more particularly described as: <br /> <br />UP-01-22 <br /> <br />Beginning at a point 74.66'+ east of the southeast corner of <br />Middle Street Mall and High Street; thence, in an easterly <br />direction 8'+ to a point; thence, in a southerly direction 30'+ <br />to a point; thence, in a westerly direction 8'+ to a point; <br />thence, in a northerly direction 30'+ to a point of the <br />beginning. <br /> <br />3. That the use permit is approved subject to the following conditions: <br /> <br />(a) The proposed location shall be limited to an art/craft gallery. <br /> <br /> (b) Business days and hours of operation shall be Monday through Saturday, <br />10:00 a.m. to 7:00 p.m. and Sunday 12:00 p.m. to 7:00 p.m. <br /> <br /> (c) All signage and exterior renovations shall be approved by the Downtown <br />Design Committee prior to the start of work. <br /> <br /> (d) The applicant shall provide an approved plan to store, handle and remove <br />trash/garbage at this site. <br /> <br /> (e) The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and maintain in <br />effect all necessary licenses and permits. <br /> <br /> (f) All taxes and fees in connection with the subject property and operation <br />shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />02 - 72 - Rezoning, code amendment, comprehensive plan and group housing <br />applications: <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Moody, to adopt the following <br />ordinances and resolutions, approved at the March 12, 2002 meeting, and was adopted <br />by the following vote: <br /> <br />02-72(a): <br /> <br />"ZONING AMENDMENT ORDINANCE Z-02-01." <br /> <br />02-72(b): <br /> <br />"ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING TABLES 40-43.1-2 AND 40-43.1-3 <br />THEREOF PERTAINING TO SUBSTANCE ADDICTION CLINICS AND <br />DETOXlFICATION CENTERS." <br /> <br /> <br />
