March 26, 2002 <br /> <br />(a) CA-02-01 <br /> <br />CITYWIDE - The City of Portsmouth requests an amendment to <br />Section 40-61.2 (9) and Section 40-61.8 of the Zoning Ordinance to <br />permit the replacement of existing billboard signage on Martin <br />Luther King Freeway. <br /> <br />1. Jim Martin, 200 High Street, spoke on approval of a non-conforming use on <br /> industrial property. <br /> <br />2. Joe Donnelly, 1050 Virginia Avenue, spoke in support of billboard signs being <br /> relocated. <br /> <br />3. Vanessa Field, 1513 Summit Avenue, spoke on changing an ordinance for one <br /> purpose and then changing it back, may set a precedent. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Whitehurst, that CA-02-01 be <br />approved on first reading. <br /> <br /> Substitute motion by Mr. Pitts, and seconded by Mr. Benn, that CA-02-01 be <br />approved without the use permit requirement, and was adopted by unanimous vote. <br /> <br />- Unfinished Business - <br /> <br />01 - 342 - Use permit: <br /> <br />01-342(d): <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Griffin, to accept the applicant's <br />withdrawal of UP-01-28, and was adopted by the following vote: <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br />02 - 08 - Use permit: <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Robinett, to adopt the following <br />resolution, approved at the March 12, 2002 meeting, and was adopted by the following <br />vote: <br /> <br />02-08(a): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO CHRISTINA FULP TO OPERATE <br />AN ART GALLERY AT 225 HIGH STREET. <br /> <br /> WHEREAS, Christina Fulp has made application pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to <br />operate an art gallery at 225 High Street, Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> <br />
