March 26, 2002 (a) CA-02-01 CITYWIDE - The City of Portsmouth requests an amendment to Section 40-61.2 (9) and Section 40-61.8 of the Zoning Ordinance to permit the replacement of existing billboard signage on Martin Luther King Freeway. 1. Jim Martin, 200 High Street, spoke on approval of a non-conforming use on industrial property. 2. Joe Donnelly, 1050 Virginia Avenue, spoke in support of billboard signs being relocated. 3. Vanessa Field, 1513 Summit Avenue, spoke on changing an ordinance for one purpose and then changing it back, may set a precedent. Motion by Mr. Benn, and seconded by Mr. Whitehurst, that CA-02-01 be approved on first reading. Substitute motion by Mr. Pitts, and seconded by Mr. Benn, that CA-02-01 be approved without the use permit requirement, and was adopted by unanimous vote. - Unfinished Business - 01 - 342 - Use permit: 01-342(d): Motion by Mr. Pitts, and seconded by Mr. Griffin, to accept the applicant's withdrawal of UP-01-28, and was adopted by the following vote: Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley Nays: None 02 - 08 - Use permit: Motion by Mr. Whitehurst, and seconded by Mr. Robinett, to adopt the following resolution, approved at the March 12, 2002 meeting, and was adopted by the following vote: 02-08(a): "A RESOLUTION GRANTING A USE PERMIT TO CHRISTINA FULP TO OPERATE AN ART GALLERY AT 225 HIGH STREET. WHEREAS, Christina Fulp has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate an art gallery at 225 High Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses;
