<br /> At a regularmeeting of the City Council Narch 13th there were present:

<br /> Nessrs~ Vernon Brooks, J. C. Dunford, Eo W. Maupin, Jr.,
<br /> Arthur Eayo, J. Alden Cast, J~ R. Stewart,
<br /> L. G. White, ?.
<br /> Also the City Ean~ger.
<br />
<br /> The minutes of the reg~ls~r meeting February 28th were read and were approved.
<br />
<br /> The City Manager reported 'fProgress, on repairs to t~e West Pa~k View Bridge and to the
<br /> question of parallel parking, and stated that he is investigating both these matters.
<br />
<br /> The following Written communications were read from the City Man~ger:
<br />
<br /> 1st. #Attabhed you will find petition of Patrolman C~ J. Whitmore asking that he be paid
<br /> the sum of $30~.43~ covering lbss of sixty-one and one-half days fromduty on account of a
<br /> motorcycle accident, in which the officer's left ankle was sprained. Whitmore was making an
<br /> effort to arrest one, Eugene Ward~ for speeding, according to statement attached, and the auto-
<br /> mobile skidded into the motorcycle, om~sing the accident. ~
<br />
<br /> ~ have investigated this matter as best I could ~nd feel that Officer Whitmore's
<br /> claim is aujUst one and that he should ~e paid the amount requested. I have full particulars
<br /> in the oa~e and whereas Ward was fined $10.00 and cost in Police Court, on the Oombined charges
<br /> of ass~i~lt with an automobile~ destroying private property and reckless driving~ I am making
<br /> am effort to hold him For damages~ if possible. Of course, this is a matter for the City
<br /> Attorney to handle and ~hope it will be the pleasure of the Council to authorize this refund.

<br /> The statement of the officer and doctor's certificate are attached."
<br /> On motion of Dr. Dunford, the recommendation of the Manager was concurred in, the amount
<br />to be paid out of appropriation in the Budget for Police Department, Salaries, and by the
<br />following vote:

<br /> 2hdc "I am enclosing herewith statement of lots sold in the City Cemeteries during the
<br />month of Februa~, 1~28.
<br />
<br /> It is recommended that the 0ity Attorney be requested t~ prepare deed for the
<br />half-lot sold in Oak Grove Cemete=y.

<br /> February ~th To 0atherine Elizabeth Hale, N.H. t06-A~ Ave. I, Oak ~rove 0emetery."

<br /> On motion, the 0ity Attorney was instructed to draft deeds for the lot sold and the
<br />City Officers authorized to execute same.

<br /> An objection to the approva~ of this application has been filed by 0. L. Oac~mus,
<br />owner of dwelling located at ?22 Fourth St., and adjoining the property owned by Nr.' La. wrenoe
<br />on th~ north. There are ~o stores already located in this block north of the property in
<br />Guestion and two corners at the intersection of Fourth and Fsyette~ are occupied by stores. I
<br />~Droved the application because I felt that the street is fast becoming a business street and
<br />the ~wellings, particularly in the vicinity of Fayette St. will, as time goes on, be turned
<br />into business houses, and at the same time ~orking to the convenience of the residents of this
<br />section.

<br /> ~r. 0admus~ complaint is the only one re,Sired. Havi~ approved the application
<br />as above stated, I am submitting these facts for your consideration. 0opy of application and
<br />complaint are attached."

<br /> On motion of Dr. Dunford, the approval by the Eanager of ~r. Lawrencefs application
<br />was concurred in.

<br /> UNFINISHED BUSINESS
<br /> The following ordinance, which had been placed on first reading by Council February 28th,
<br />was taken up and read:
<br /> AN ORDINANOE TO GRANT TO THE CHESAPEAKE AND PO~OEA0 TELEPHONE COMPANY
<br />OF VIRGINIA~ ITS SUCCESSORS AND ASSIGNS, THE FRANCHISE~ RIGHT AND PRIVILEGE TO£ONSTRUCT,
<br />MAINTAIN,AN~ OPERATE UPON THE STREETS, HIGHWAYS, AND PUBLIO PLACES OF THE CITY OF PORTSMOUTH,
<br />A TELEPHONE ~SYSTEM, WITH THE NEOESSARY POLES, CONDUITS, ~OLES, DUOTS, 0ABLES, ~IRES, AND
<br />ALL OTHER NECESSARY OVERHEAD AND UNDERGROUND APPARATUS AND FIXTURES.

<br /> On motion of Dr. Dunford, the ordinance was adopted, and by the following vote:

<br /> The City Attorney p~esented the following ordinance, which he had been instructed to draft
<br />by 0ouncil February 28th,
<br /> An Ordinance Authorizing the Issuance of One Hundred ~d Twenty-three
<br />Thousand Dollars of Refunding Bonds of the City of Portsmouth, Virginia; Naking Provision for
<br />the Form of said Bonds and for the P~yment Thereof.
<br />
<br /> On motion of Nr. White~ the ordinance was placed on first reading.
