Honorable City Council,

"Portsmouth, Va., Oct. 9, 1928.

Gentlemen:-

At your meeting of September llth you referred to me a reouest from Mr. J. O.-Griffin
to have refunded the sum of $27 paid by him for fine ~nd costs in the Police Court on a charge
of reckless driving. The facts im the case are, that Mr; Griffin was fined in the Police Court
and paid his fine and costs. A day or two later he returned to the office of the Poli3e Jus-
tice with a lawyer ~ud noted ~u appeal. Mr. Milford ~elieving that he had ten days in which
to note an appeal, aent the warrant to the 01erk of the Court of Hustings. The case was duly
docketed and was tried before a jury ~nd the charge ~gainst Mr. Griffin was dismissed. H~. I
known ~t the time that the fine had been paid I would have requested the Court to dismiss the
appea~, which I believe would have been done. However the case was fairly tried and Er. Griffin
w~s ~ound not guilty and naturally feels that his money should be returned to him. Under the
circumstances it appears to me this~houtd be done. I have requested Mr. Milford not to permit
~ny more appeals ~fter the ~ine has been paid.

Yours very truly,

R. C. BAROLAY, City Attorney."

Dunford moved tha~ the report of the City Attorney be approved, s~ud that
mppropriation of $2[.O0 be allowed to take care of the refund.
The mo~ion~was adopted.
