The fotlowing~Order of Cou~t was presented: #VIRGINIA: June, 1929: At the Court of Hustings for the City of Portsmouth, held on the 25th day of Eugene Jones, C. J. Jones, Wm. R. Jones, 6. H. Butts, Jos. R. ~alker, Trustees of the First Baptist Church of ~o~th Portsmouth, Plaintiffs, VS. City of Portsmouth, a Municipal Oorporation, Defendant. This day came the plaintiffs and applied to the Cou~t for relief from certain assessments of real estate,-ctaimed to be erroneous mud thereupon, came R. C. Barclay, City Attorney f~r the Oity of Portsmouth, and R. B. Albert son, Commonwealth.s Attorney, to defend said application, and likewise. Game John C. Niemeyer, Commissioner of Revenue, who made the sesaments in questio~ and who was examined as a witness touching the ~oplication. It appearing to the Oourt that certain property situated in the City of Portsmouth, State of Virginia, was assessed for the years 1927 and 1928 to John R. Riddick, and for the year 1929 to Equitable Building & Loan Association, of the City of Norfolk, said assessments appearing in the land books for said yea~s, as follows: 1927 page 402 line 17 1928 page 405 /line 9 1929 page 87 line 2?; and the cou~vt~being of opinion that the property above assessed was, when the assessments for 1927 and 1928 were made, owned by a religious congregation and used exclusively for religious purposes; IT IS ORDERED that the said property be exonerated for the year~ 1927 and 1928, that the same be stricken from the land books and delinquent tax records. The amounts now delinquent for the several yee~rs above mentiomed and h~rein exenerated~ are as follows: YEAR AMOUNT 1927 1928 $579.5 But the Oou~t being of opinion that said property was not held for the benefit of said church congregation when the assessment for the year 1929 was m~de, doth confirm said assess- ment for said yea~ and doth deny relief therefrom. The Clerk of the court is hereby directed to transmit an attested copy of this order to the Portsmouth City 0ouncil, the City Collector, and the Auditor of Public Accounts. A copy, Teste: L.L. Thompson, Clerk, By Nellie M. Calvert, D.C." On motion, the Order of Court was referred to the City Attorney. The report of Frederick B. Hill &Co., accountants, of the audit of the ferry accounts for the month of June, 1929, was received, ~ud ordered to be filed. On motion, adjourned.
