The fotlowing~Order of Cou~t was presented: <br />#VIRGINIA: <br /> <br />June, 1929: <br /> <br />At the Court of Hustings for the City of Portsmouth, held on the 25th day of <br /> <br />Eugene Jones, C. J. Jones, <br />Wm. R. Jones, 6. H. Butts, <br />Jos. R. ~alker, Trustees of <br />the First Baptist Church of <br />~o~th Portsmouth, Plaintiffs, <br /> <br />VS. <br /> <br />City of Portsmouth, a Municipal <br />Oorporation, Defendant. <br /> <br /> This day came the plaintiffs and applied to the Cou~t for relief from certain assessments <br />of real estate,-ctaimed to be erroneous mud thereupon, came R. C. Barclay, City Attorney <br />f~r the Oity of Portsmouth, and R. B. Albert son, Commonwealth.s Attorney, to defend said <br />application, and likewise. Game John C. Niemeyer, Commissioner of Revenue, who made the <br />sesaments in questio~ and who was examined as a witness touching the ~oplication. <br /> <br /> It appearing to the Oourt that certain property situated in the City of Portsmouth, <br />State of Virginia, was assessed for the years 1927 and 1928 to John R. Riddick, and for the <br />year 1929 to Equitable Building & Loan Association, of the City of Norfolk, said assessments <br />appearing in the land books for said yea~s, as follows: <br /> <br />1927 page 402 line 17 <br />1928 page 405 /line 9 <br />1929 page 87 line 2?; <br /> <br />and <br /> <br /> the cou~vt~being of opinion that the property above assessed was, when the assessments for <br />1927 and 1928 were made, owned by a religious congregation and used exclusively for religious <br />purposes; <br /> <br /> IT IS ORDERED that the said property be exonerated for the year~ 1927 and 1928, <br />that the same be stricken from the land books and delinquent tax records. The amounts now <br />delinquent for the several yee~rs above mentiomed and h~rein exenerated~ are as follows: <br /> <br />YEAR AMOUNT <br /> <br />1927 <br /> <br />1928 $579.5 <br /> <br /> But the Oou~t being of opinion that said property was not held for the benefit of said <br />church congregation when the assessment for the year 1929 was m~de, doth confirm said assess- <br />ment for said yea~ and doth deny relief therefrom. The Clerk of the court is hereby directed <br />to transmit an attested copy of this order to the Portsmouth City 0ouncil, the City Collector, <br />and the Auditor of Public Accounts. <br /> <br />A copy, <br /> <br />Teste: L.L.
