<br />ptroller, stating that the act-passed by the Legislature and referred to as~Ohapter 91. of the
<br />Acts of Geners~i Assembly of 1930, is unconstitutional and to disregard the letter of June l~th,
<br />193o.

<br /> Therefore, I am asking that the City 0ou~ucil order theft the 0ity Auditor draw a check
<br />payable to the Treasurer of~ the Oommonwe~lth of virginia or L. L. Thompson, Clerk 'of the Cou~t
<br />of Hustings fo= the sum of $979.12, which has been paid in to the Oity Collector.

<br /> I am enclosing copies of letters received by me on June 14th, 1930 and June 26th, 1930,

<br />_ 1._ That on~ Js~uuary, ?, 1929, they purchased from Ranzo ffilgus two (2) lots of lend num-
<br />oered 1~9t and 1492 on She plat of Port~orfolk, both lots bein~ conveyedby the same deed.

<br /> 2. That in November 1929 upon an attempt to pay taxes on .this property they were in-
<br />formed by the Oity Collector.s Office that taxes were due on lot num~ber 149~ for the yea~s
<br />~9om 1919 to 1929, both inclusive, and that upon ~n investigation they found ~h~t lo~ ~umber
<br /> t had been continmously assessed for those yea~s in the ~ame of the Columbian Real -Estate
<br />0orporat~on although it w.a~ purchased by Ranzo Nilgus from the Oolumbian Real Estate Corpo-
<br />ration in 1919 together wzth lot ~1492, both by the same deed, aud the assessment had never
<br />been changed on the land books.

<br /> 3~ For the yeams from 1919 to 1923, both inclusive, this Iot was assessed wi~h s~uother
<br />lot ms being on ~aryta~d Avenue while as a matter of f~cl lot number 1~1 is located on the
<br />east side of Hamilton Avenue.

<br /> That lot ra~mber. 1~2 was properly assessed ~o Ra~zo Wilgus for these years but that
<br />th-ereYw~s ohamged against %he s~d to~'for the six ye~s from 1919t0 1924, both incisive,

<br /> 5* Tha~ for the yes~v-1923 the said lot ~l~9tis delinquent in the 'State delinquent land
<br />b~ok in the nameof the0olumbian~Reai Estate Oorporationas being on Ns~vyI~udAvenue,-and
<br />for the yes~v 1924 it is delinquent as being O~mH~ilt0n Avenue.

<br /> In ~s much as you~ petitioners have paid, eitherthemselves or through the:former
<br />owners of the'property, more ~e~ th~n weredue by reason of improper assesamen~s of improver
<br />merits on lot~$1492when infact there were ~no improvements-onthe said property, they respec~-
<br />fully petition your honorable body to relieve them of the charges now standing in the name
<br />of the 0olumbian Real Estate Corporation against lot ~$14.91, ~u~ that you will direct the 0ity
<br />0ollector to mark these payments c~nceled, particularly since the ~proper assessment has now
<br />been corrected and the l~ad books will now show a proper assessment of the ~aid real estate.
<br />For the information of your honorable body the City Attorney is familiar, with this situation.
<br />
<br /> I feel sure ~hat you h~ve no desire to force persons to pay more th~n the amount due
<br />by reason of taxes and in consequence of the payments to the city alreadym~de~ounting to
<br />more than the taxes which would have been due had the property been prol~st!y assessed, the
<br />city has lo~t nothing a~d the only loss has f~llen upon your petiti.one~s, o~ the former holders
<br />· of the title.
