November 13, 1995 (d) UP-94-02 (M) CRADOCK NEIGHBORHOOD - Request of the Help and Emergency Response Shelter to modify conditions of a previously approved use permit to expand their playground area. Motion by Mr. Robinett, and seconded by Mr. Pitts, to concur with the recommendation of the Planning Commission that UP-94-02(M) be approved, and was adopted by unanimous vote. (f) UP-95-22 CAVALIER MANOR NEIGHBORHOOD - Use permit application of Mary Staton for residential care facility at 104 Median Circle. Rachael Benzie, 2604 Sterling Point Drive, spoke in support of the application. William Harrell, 104 Median Circle, provided information on the application. Mary Staton, 104 Median Circle, provided information on the application. Motion by Mr. Griffin, and seconded by Mr. Pitts, to concur with the recommendation of the Planning Commission that UP-95-22 be approved, and was adopted by a vote of 6-0-1(Robinett abstained due a conflict in business interest). (g) CA-95-11 CODE AMENDMENT - A proposed amendment to the City Code, Chapter 40 of the Zoning Ordinance to create an Archaeological Ordinance. Motion by Mr. Hawks, and seconded by Mr. Griffin, to table consideration of CA-95-11, and was adopted by unanimous vote. UNFINISHED BUSINESS 95-412 - Public hearing on a comprehensive plan amendment: (h) CP-95-05 COMPREHENSIVE PLAN AMENDMENT - An amendment to the City of Portsmouth Comprehensive Plan Technical Report, 1988, to revise statistical information, deferred from the September 11, 1995 Public Hearing meeting. Motion by Mr. Martin, and seconded by Mr. Robinett, to concur with the recommendation of the Planning Commission that CP-95-05 be approved, and was adopted by unanimous vote.
