November 14, 1995 <br /> <br /> NOW, THEREFOR~,~BE IT RE~LVED by the Council of <br />of Portsmouth, Virginia: <br /> <br />28% <br /> <br />the City <br /> <br /> 1. That the use for which the permit hereinafter- <br />described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of <br />persons residing or working in the neighborhood of the proposed <br /> <br /> (b) Will not be detrimental to the public use or injurious <br />to the property or improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure <br />compatibility with surrounding uses; <br /> <br /> {d) Will be a project that will be developed according to <br />a plan for parking, driveways, and curb cuts which will provide <br />for safe and convenient traffic movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City of <br />Portsmouth Zoning Ordinance. <br /> <br /> 2. That Use Permit UP-94-02, previously granted to Help <br />and Emergency Response (HER), is hereby amended pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia <br />(1988) to permit the operation of a residential care facility <br />for women and children on property located in the City of <br />Portsmouth, said property being more particularly described as: <br /> <br />UP-94-02(M) <br /> <br /> Beginning at the southeast intersection of Channing Avenue <br />and Harris Road; thence eas~ along the southern right-of-way of <br />Channing Avenue 200'; thence south along said right of way 175' <br />to a point, thence west 100' more or less to a point; thence <br />sodth 50' more or less to a point; thence west 100' more or less <br />to the eastern right-of-way of Harris Road; thence north along <br />said right of way to the point of beginning. <br /> <br />3. That the amended use permit ~S approved subject to the <br />following conditions: <br /> <br />(a) The proposed play area shall be fenced by a six-foot high <br />wooden "dog ear'~ style stockade fence. <br /> <br />(b) Vehicular access to the play area shall be limited to the <br />existing entrance to the facility. <br /> <br />(c) Shrubs shall be planted between the fence and the <br />right-of-way of the adjoining street. <br /> <br />(d) Ail conditions previously established for the operation of <br />the facility under Use Permit UP-94-02, approved by resolution <br />of the Council of the City of Portsmouth, Virginia, on February <br />22, 1994, shall remain in full force and effect." <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br /> <br />95-494 - Non-Agenda Speakers <br /> <br />1.
